Florida has passed a new law that went into effect on July 1, 2010. This new law states that if the homeowner is not paying the HOA fees to the association, the association can require the renter to pay these fees directly and send the balance of the monthly rent check to the landlord. The renter should keep copies of the notice from the HOA demanding payment as well as copies of the canceled checks. If the landlord demands full payment, the renter should provide the landlord with copies of the paperwork.

Naturally this gets complicated if the landlord wants to evict the tenant since this can still happen. The paperwork showing proof of payment does not necessarily mean the tenant can stay in the rental unit. This is REALLY a case of being sure that your landlord is able to pay the monthly HOA fees and asking for proof BEFORE signing a lease! This is something most tenants would not think of and is really a shame that they have to think of!

It is too bad that it has come to this but many HOA associations cannot pay their bills because condo owners are not paying the monthly fees. To make it possible for the HOA to pay their bills on time so that the facilities in the development remain open and cared for, this new law was passed here in the Sunshine State!!!

There is more and more you have to consider when renting in this market of uncertainty!
