The Home Affordable Modification Program, HAMP, has seen new trial modifications drop 90 percent since September, an indication that the beleaguered foreclosure rescue program is reaching the limits of its usefulness. Often criticized for not saving the promised millions from foreclosure, HAMP’s latest report indicates significant declines in the number of new homeowners accepted into the program and a dramatic increase in the number of trial modifications that have been rejected.

 

In reality, it’s always been impossible for the administration to keep 7 to 9 million families from losing their homes; and the emotions and finances of millions of homeowners should never have been used for political means. Far too many of the nation’s troubled mortgages do not qualify for modification, and many who are accepted are so deeply in debt that success is impossible, failings of which politicians and bureaucrats have been aware since HAMP was first announced.

 

Additionally, many of those accepted for loan modification will ultimately lose their home as its value is far below the amount owed. In a recent POST I described how many of those already accepted into the program will ultimately choose strategic default. With the average homeowner in modification owing 50 percent more than their home’s value, and aware that they are, in reality, only “renting,” large numbers will simply choose to walk away.

 

Since its inception, the weaknesses of HAMP have been apparent; and I’ve described some of them in past blog posts. However, the program’s shortcomings are not the point. By providing an element of hope, false hope, the government has made the situation worse for hundreds of thousands of homeowners who have used their remaining cash in trying to qualify for a program that would ultimately fail to “save” them. Instead of providing a vague promise, it would have been far better if those administering the program would have made it clear who qualified and who did not. Doing so would have helped struggling homeowners avoid a pointless and frustrating exercise that was doomed from the start.

I figure if people can delay losing their home even awhile and at least get a chance to save their home, good for them. Even if only 10% make it, at least it is 10% not in foreclosure

Lori - We certainly need to avoid all the foreclosures possible; but the frustration for most entering HAMP is that they believe they'll receive help, and only a few will.

This was never more than a public relations scheme to make the government look compasionate when they designed the program to ensure a low acceptance, high drop out, low success rate. 

These programs are the most cynical of government actions by promising relief and causing home owners to invest their remaining resources into the hope of false promises.

Imagine how the market would have turned if the home owners were given relief similar to that of the tanks receiving TARP funds.  HA!  They didn't even have to promise to repay.

The question is, are the home owners failing?  Or was the program designed to fail.  Common sense when reading the guidelines would show any sentient person that failure was guaranteed. 

So, in effect, the program is doing just what it is designed to do.  It provided limited help to a limited number of home owners and then only enough to get some press but the program was never designed to cause a ripple in the number of foreclosures, which, of course it never did.

Fabulous post, John. The only way loan modification would work is if the refinanced amount equals current market value and the rest of the debt is forgiven.

John, a very important post, thank you. Loan mods will help some borrowers but for many it's delaying the inevitable because of the general weakness of the economy.

John, very informative post.  I have to agree with Lenn on all points.  HAMP was designed to fail, and the saddest part is I've seen homeowners take money from their retirement accounts, or borrow from their parents, to try to save their home, only in the end to lose it.

John, I also have to agree with Lenn; this program was for the publics perception of providing aid to homeowners.  I know of only one person who has qualified for the modification, and personally, I don't think he is going to be able to sustain it and eventually he will loose his home.  Our Government won't give real help to it's homeowners but, from what I heard this morning, will now be bailing out small independent banks even if they are not "viable".  What have we come to?

The banks are back on track giving trial loan mods... it just doesn't work out like we thought it would!

The trial modification is just another bank tactic to grab money - The banks were faced with upside down homes and non-paying homeowners, so they did what they had always been doing - whatever it took to keep their profits going - they promised to help homeowners if Uncle Sam would give them money, and they GOT BILLIONS in bailout money from taxpayers... they then gave the homeowners trial modifications to make it seem as though they were keeping their promises, and in so doing they continued to GET BILLIONS in bailout money PLUS MORE MONEY from the homeowners who otherwise would never have paid another dime to the banks... then when the time was right to foreclose - meaning the inventory was controlled and the borrower was out of any spare cash, sell the home through foreclosure and GET ANOTHER BIG PAYMENT... then if there was any kind of insurance against foreclosure, collect MORE MONEY on that policy.

This scam should not go without recourse. In California, there are laws in place to address such breaches of promise... and many law firms, mine included, take people who have fallen prey to the TRIAL MODIFICATION SCAM and make them into plaintiffs against their lenders. By joining plaintiffs with similar patterns of lender abuse together, these homeowners are able to afford aggressive litigation against the big banks.
