INVESTORS TIPS ~ Hazardous Substances

There are areas of Jacksonville Florida where incinerator ash was used like dirt to fill in low lying areas for development years ago, according to a story on Jacksonville.com.

A law suit is being asked for class-action status by residents who say their property values have been affected. They do not understand why their properties have been labeled potentially hazardous even though there have been no tests done to determine that the hazardous substances are on the property. 

The notice is on the Legal Description and looks like this:

Investors ~ especially out of town and out of state investors need to make sure they do their due diligence when buying properties in the Jacksonville Florida area. With low prices and great deals to be had, it is tempting to just write an offer with no contingencies. This is one huge reason why that may not be the best course to take.

Relatively recently mold was not even mentioned on the contracts, and I would not be surprised if 30 years ago radon gas was not mentioned either.

People add (and never subtract) to this list. To the point that it may even be unfair to the homeowners. Putting a stigma at best, or making it worthless at worst

You can never get rid of the label once it has been established.  It is unfortunate, but usually the case. 

It will be on the internet forever.

Jon, the neighborhoods where this label has been applied just can't afford any more loss in value. It seems like they should have to test first, label last, but it's the other way around.

Don, indeed. It's sad because they haven't tested to verify it.

"There are or may be" those who cry wolf. I am thinking that regardless of where the land is located, if it has been touched by man, there are or may be hazardous waste.  I think it is all the lawyers fault!
