I don't usually do rentals I prefer to sell. However every once in a while a client will call that needs a rental usually a short term rental during a renovation or as an interim until they buy something. Often they will say "I don't want to pay a Broker Fee. I'm a broker, broker's get a fee. I tell them to look on Craigslist.

In the past I have had exclusive rental listings when the rental market was not as tight as it is now. I would have the owners pay the broker fee so I legitimately could advertise "No Fee".

Scroll through rental advertisements on Craigslist, you will notice many "NO FEE" alerts with asterisks and exclamation points for maximum visibility.

Unfortunately most of these postings are not for real they are bogus. A city council report released last week warned that about a third of brokers who list no-fee properties are lying.

In September, the City Committee on Oversights and Investigations called 223 real estate agents who had advertised no-fee apartments on craigslist.org and backpage.com, two popular websites that list  classified ads. When asked if they charged a broker's fee, 31% said they did, despite their ad. Another 4% said the cost was actually noted on the posting, in miniature print at the bottom. Of those fees, 87% charged one month's rent or 10 to 15% of the annual rent.

Another activity that many of these agents are doing that was not in the City Council report but I discovered last week when a client and friend called me about a listing in Craigslist that sounded like it was in my building is that these agents are advertising other agents exclusive listings. They don't give the exact address and only have a cell phone number in the ad. When they tell the caller about the fee they tell them there is another agent involved.

You can not put an ad in a newspaper that is dishonest. Newspapers ads are expensive and every Tom Dick and Harry agent does not have an account or would not be authorized to put an ad in The New York Times. Craigslist is free and it takes 1 minute to post an ad and you can post anonymously.

The committee suggested that the department increase its fines for violations, which range from $50 to $500, and that it relay any findings to the state Department of state, which can revoke an agent's licence.

Craigslist founder and owner Craig Newmark said they kick repeat offenders off the site. They currently rely on the community and other brokers to report the bad apples.

I am not sure I understand.  Who receives the fee?  And who usually pays it when it is done right?

Real estate is local.  We don't have this issue in Metro Detroit...

The renter has to pay. It is usually 15% of 1 years rent or sometimes 1 month rent. It is split between 2 brokers. Rarely does the owner or landlord pay. That is why everyone is looking for "No Fee"

Mitchell,

When a licensed agent is misrepresenting (not puffery) or using another agent's listings without their permission - I would hope that someone would file an ethics complaint with the local Board of REALTORS and a complaint with the state real estate commission.

Also, are the bad apples advertising according to the state laws?

Many of these rental agents do not belong to any local boards. We have REBNY the real estate board of New York and MANAR the Manhattan association of REALTORS. I belong to both.

I believe they are violating state laws.

She just walked out of my office.  She got in a car accident last week and life has been hectic for her. She is fine. The car was totaled.

I will tell her you said that.  It will make her day.

You are my first comment in almost 2 weeks.  Spoke to Maureen today and she mentioned that Craig posted on your blog.  To my suprise, I too was mentioned in this thread.  WOW!  Good for you for capturing that audience.  Thank you for mentioning that you miss me.  I miss you too!

I'm happy that you posted this.  I just was starting to investigate Craig's List.  I'm considering posting my listings there.  I have several listings that are for both Sale and Lease.  So thank you for the insite to your market & for bringing Craig's List to the forefront of my thoughts again.

I will try to stay around this time.  Its been difficult.  I've been working at my SOI the old fashion way... networking & party going.  Again, love that article you sent me.  That was a real kick in the pants for me.  Made me remember to do what I do best.

As Maureen mentioned, things have been hectic.  I was in an accident last week.  I was "t-boned" by a woman running a red light.  I was knocked around, but all in all, I'm fine.

I'm honored. It is so great to hear from you. I am so sorry about the accident but thank God you didn't get hurt. Puts things in perspective doesn't it?

What I wrote about no fee listings is very specific to New York City. Manhattan is still 75% rental apartments. It is unique to nyc that the tenant pays the fee. I only take rentals if I'm the exclusive listing agent. Many of these ads are open listings.

As far as your listings, Craigs list is a great place for them. You get 4 pictures, you can link to your listings page. I like to put listings on Craigslist the morning of an open house. My headline is Open House Today. The response usually comes right after you post.

Working SOI networking and partying is still the best way just like those super agents. Write your blog once in a while you have good things to say and you're still #2 in Michigan and Maureen is still #1

Hi Mitchell, I don't know how I missed this.  I am spabapping myself for missing this.  In NYC, aren't the brokers getting charged for apartment listings?  We are here in Queens.  I forever see agents posting apartments in the NO BROKER section. 

When I started advertising on Craigslist, it was free.  I was on AVERAGE for apartments only about 30 calls a day!  Once the rules changed and fees got involved, I noticed that alot of brokers did stop advertising on there - but not a huge decrease.  My calls went from about 30 down to about 7 a day.  (we have three offices now too).  But anyhow, I saw at the same time the fees got in forced ALOT like triple the amount of OWNERS posting there.  Hmmmmmmmm.. Not really owners. 

As for the fair housing issue - that should come down on the owners/brokers and agents. Not Craig himself.  He can not possibly monitor ALL ads.  He is just the messenger in this senario -

As far as I know the fee is $10.a listing for rental apartment brokers only. He only started charging to reduce all the fraud. It's not only the unethical brokers there are these apartment information vendors and they spam craigslist from computers in asia so he can't get their IP address. He never had a problem with apartment brokers until they started Craigslist in NY. You know New York is really competitive and we have some really aggressive broker. Especially the rental market is so tight.

It's still free under Real Estate For Sale. I post when ever I have an Open House.

I agree Craig is just the messenger. He is a good guy with a conscience.  He does call the bad brokers himself.

Great post Mitchell, thanks for drawing my attention to it.  I missed it the first time around.

I can't believe those swindling brokers; makes me mad.  And that they would pose themselves as representatives of other broker's listings!!!

I do have to admit that as a non-broker, sometimes I am annoyed when searching CL to have to sift through all the brokers listings to find actual owners.  I feel like CL is meant to be a community for personal owners.  Just like if I find stores listing their goods (with links to their website) in the furniture section.

Definitely worth a gold star ;)

Have you tried backpage.com? it's the village voice they are free. I've tried it a few times for sales didn't get any response but the village voice was always good for rentals even before the internet.

Mitchell, perhaps someone should just report the guilty parties to the NAR ethics committee for enforcement - I think a few harsh directives from them would get the word out quickly to any REALTOR that wanted to break the rules.  At least that narrows down the list of guilty parties.  If anyone from the NAR is reading this, if you want to help the reputation of our trademark (REALTOR) this needs to be done and the public needs to be made aware of it.

Gabriel, These brokers are not members of NAR. They don't belong to any real estate board. They are with fly by night companies. I think they should give their license number when they post an ad and get reported to Department of State.

One thing one of my mentors told me was that ethics comes from the heart. Regardless of the title or position, you will always have criminal behavior within the real estate industry.

Concerning Craigslist, I do my part by flagging non-compliant ads and promoting compliance whenever I can.
