Genzyme CorporationUpdate on the Genzyme "Damaged" Home on Route 30 in Southborough 

Two days ago, I wrote a post about a home that I had passed by on Route 30 that displayed signs on the property claiming that Genzyme Corporation has ruined their home.   I asked for answers and received one - from one of my readers. 

She kindly sent me an article that was printed on June 7 in the MetroWest Daily News.  

The home in question is actually over the town line of Framingham and is located in Southborough.  This is an area that is directly across from a three-story parking garage belonging to Genzyme Corporation.  The owner of the home, Theo Kehaias claims that the new garage was built with a faulty drainpipe. 

The drainpipe runs beneath the garage connecting a brook behind Mr. Kehaias's home with its terminus at the Sudbury Reservoir.  

Apparently, there was an intense flood that forced the occupants at 248 Boston Road to evacuate the property.  The home has been vacant since July 7 when the Red Cross moved the family into an emergency shelter following a propane tank rupture which was caused by the severe flooding. 

Mr. Kehaias insists that the flooding situation is due to the Genzyme parking garage and claims that since the structure went up his property has been flooded at least five times. 

The vice president of Genzyme's Massachusetts operations disputes the fact that the parking garage has had anything to do with the woes at 248 Boston Road. 

The current assessment of the ranch home is $247,100 and one avenue that has been explored is to ask Genzyme toGenzyme House purchase it.  At this point the company has expressed that it has no interest in buying the property. 

With much frustration and, apparently, no home to live in, Mr. Kehaias began his display of signage on May 29.  Every day as workers pull into the parking lot on Route 30 they are greeted with signs that read, "Genzyme Flooded This House" and "Genzyme Ruined This House." 

What will become of the legal battle between this large corporation and the owner of 248 Boston Post Road?

It seems like unfair odds, doesn't it? I don't know how they would have the resources to try to prove that this happened to their home.

Claudette, great follow up. It's amazing how a change in the topography or construction can have such a profound eggevt on neighbors. It wil be interesting to see how this plays out!

Yes, it will be interesting to see if the owners of this home are able to prove anything in court about this. They would probably have to hire their own people to investigate this and it does not really sound as if they have the means to do that.  I hate the see the little guy be so overshadowed by a large corporation.

It was fabulous talking with you, I hope we do it again.

These things usually take quite some time to get into court.  But, I will be watching the progress.

You are so right.  I wonder if Erin is still in business. She may not be available after all of the notoriety she received from having Julia Roberts play her in a movie.  But, yes, that would be a good call.

Hard to believe that the drainage from the garage would flood out the brook since in my experience getting projects approved, drainage calculations have to be submitted by a civil engineer as part of the design.  The idea is to prove that there will be no flooding as a result of the drain plan.  As difficult as conservation commissions can be, often putting restrictions on development that are above and beyond, I would think Genzyme was likely put through some pretty serious scrutiny before the garage was approved.  How's that for counterpoint?!

It is a great counterpoint! A large corporation, or anyone for that matter would have to undergo some scrutiny before building a large structure like a three-tiered garage.  And, Southborough is a town that is pretty restrictive about the environment.  So, will we see a court case? I wonder if this owner will be able to bring evidence that would support it. I will be curious to see what happens in this.
