Use Caution When Text Messaging Clients - Article in Wisconsin Real Estate Magazine

A recent article by Cori Lamont in Wisconsin Real Estate Magazine points out the hidden risks involved in texting real estate clients.

The article addresses the following points:

  • Texting or sending emails while operating a motor vehicle is illegal in Wisconsin and most (if not all) other states.
  • Texting someone without permission may have consequences.
  • Avoid texting confidential information.
  • Do not negotiate terms of a real estate transaction in a text message.
  • Fair Housing laws and CAN-SPAM laws, as well as the Realtor Code of Ethics, apply to text messages, as well as to email messages.
  • Keeping records of a conversation can be especially difficult with text messages.

We're noticing more and more clients who seem to prefer communicating by text message.  Text messaging is convenient and fast.  But real estate professionals need to be aware of the challenges and pitfalls.

I deal with the record keeping problem by forwarding client text messages to my Gmail account.  I archive these messages by client.  And I keep my texting correspondence to a minimum, dealing mostly with things like verifying appointments or suggesting a Web link.

I love text messaging, but I understand its limitations and liabilities.  How do you handle these issues in your office?

Although I do text clients that choose this method of communicating, I still prefer email.

Stewart, I prefer email myself as well. But being able to text and receive texts from a client has helped me on more than one occasion to keep a deal together.  I think it's important to consider best practices at those times when texting is a necessity.

I think we have to plug into our clients' preferences.  Some people love the phone, hate email; hate email but love instant messaging; will answeer a text ASAP but not even listen to your voicemail or answer the phone if it is right in their lap.

P.S. My biggest concern is lack of record of important conversations if you have texted.  They can be forwarded to email, though, can't they, depending on your service.  That would be worth trying.

Fast forward to 2013:)

Texting is not unlimited and we heavily rely on it.

Though, there are times when picking up the phone is necessary.  Sometimes in some complex situations when we need to be sure the client understands what he/she should be doing. I have found that it works to text the following:  "Please call me when you have time to discuss an important concern".  This will get them to respond in the way that you need them to respond.
