EPA Publishes New Lead Paint Rule   New Rule Affects Pre-1978 Buildings

It is impoprtant for all homeowners, contrators and  Realtors to know these new rules if you are thinking of renovating any  building 32 year old or older.

This book is for all Contractors who perform Renovation, Repairs, or Painting on homes or buildings built prior to 1978 must provide Owners, Tenants, and Child-Care facilities with a copy of EPA's Lead Hazard Information Pamphlet. Renovate Right has important lead hazard information.
This is an 16 page booklet printed in color on enameled paper. This is the latest version released.

As of March 31, 2008, the EPA has published a new lead paint rule. The rule contains important new requirements for renovators of pre-1978 property and all rental property owners of pre-1978 property. The new rule applies to all pre-1978 rental property, pre-1978 day care centers, and pre-1978 kindergarten buildings.

Children under the age of six are especially susceptible to the health effects of lead. Lead can cause learning disabilities and interfere with brain development. Seventy-five percent of houses built before 1978 contain lead paint. Varnish can also contain lead. A major source of children's exposure to lead is from dust, not necessarily eating paint chips.

Existing Rules:

 

Since 1996 home sellers and residential property owners have been required to hand out the pamphlet "Protect Your Family From Lead in Your Home" at the time of sale or at the beginning of the lease.

Since 1999, renovators have been required to hand out the "Protect Your Family..." booklet when disturbing more than 2 square feet of residential property.

There are numerous types of residential grant programs that require lead safe work practices.

Summary of New Rules:

Beginning in June 2008 a "Renovate Right" brochure can now be handed out before renovation to child-occupied facilities, which includes day care centers and kindergartens in addition to residential properties, prior to renovation.

Beginning in April 2010, renovations in all pre-1978 residential property and child-occupied facilities will require the use of lead-safe work practices, the presence of a person on the crew that has completed a one-day Lead Safe Work class and the requirement for a cleaning verification.

Certified Renovator - one per crew that has completed a one-day Lead Safe Work class - trained maintenance personnel and contractors

Lead Safe Work Practices - with the use of HEPA vacuums *Dust Control *Notification - to tenants and occupants

What You Should Do:

If you recommend contractors, make sure they have a Lead Safe Renovator on staff.

Inform homeowners that any last minute repairs to the home should be conducted in a lead safe manner so that a lead hazard is not created and delays the sale of the property.

This might be old news to some but the majority of home owners have no idea and the majority of contractors are not practicing it, just drove by a 100 year old house getting sanded like crazy with no protection. We as Realtors need to get the word out !!!  Thanks Dave

Thanks, Dave. It is an ongoing process and we need to educate in so many ways, especially when young children are so affected.

Some of the worst contractor offenses are not contractors at all, but inexperienced, enthusiastic handyman-types who just jump in and offer to do odd jobs on the cheap and take advantage of uninformed homeowners with limited income.
