Clearing Chain of  Title Issues Oklahoma- Hanging Tight With Your Home Sale Transactions!

First let me say that I am NOT an attorney and I am NOT giving legal advice

As a Real Estate Broker in Southeast Oklahoma, I hang tight with my transactions.  When I have a
sale contract on a property that I have listed, I make just about every step that happens in that transaction.

Oh yes, there are specialized professionals at every step too.  Like the chain of title in our abstracts.  When the seller's abstract is brought up to date, it goes to the attorney for a TO (Title Opinion).

When that title opinion is finished,

  • I want a copy.
  • I always ask for a copy.
  • I usually get a copy.

I want to know if there are any title issues that are going to have to be dealt with and if there are, get busy helping to clear them up.

We can provide you with a list of local attorneys in Idabel  when someone does not already have an attorney.  That list will contain attorneys  that  are timely in their work.    They understand that time is of the essence in real estate transactions that Judi Barrett at Integrity Real Estate Services is very involved in her transactions.

I appreciate that ability to work with those offices and their willingness to work with me on my desire to have that TO quickly.

So what kind of Title Issues might there be in Abstracts that would have to cleared...

  • Probate Issues
  • Missing chain of title deeds
  • Stray Deeds
  • Marital statuses missing..
  • Mortgage releases
  • Divorces
  • Surviving Spouse on Joint Tenancy Forms Missing
  • Bankruptcies
  • Mechanics Leins
  • Legal Descripton discrepancies
  • Sometimes just a broken chain of title and it takes a little digging to find out.
  • These are just a few of the title issues that we've helped with.  I love using a closer that helps to get these things cleared also.

Sometimes I feel like a PI, trying to find someone that showed up in the abstract from 40 years ago and does not live here anymore.. but we need their signature on something.

When all else fails, sometimes it has to go back to the attorney for a quiet title.. that delays everything by at least 90 days and adds cost to transaction for the seller.  That's why this real estate professional, Judi Barrett at Integrity Real Estate Services tries really really hard to get those things cleared up without the title having to go into quiet title suit through the court system.

Choosing professionals at each step of the transaction is important.

***Choose  professionals that that will  do the best job.***

I do NOT receive referral fees or any type of compensation for providing a list of professionals. You can go through the list and choose the one that you want to work for you.

Whether it's an attorney, a termite inspector, a home inspector, a surveyor, a closer... or any other professional that is needed to get to the closing table... it's important that you as a seller or as a buyer use people that do a good job, do it in a timely fashion, and are willing work with your real estate agent.

Judi...so true. The whole process can be smooth if everyone knows what they are doing and works together...one bad professional usually cause a lot more work for the Realtor who seems the one to jumps thru hoops to get er done!!!!

Judi, I still can't use to that term "Abstract Title" but I do enjoy reading about how things are done in other States, and Joan is right we need more agents like you in the business.

Debbie,

Oklahoma law makes it very plain that it is the real estate brokers responsibility for closing.  I take that much more seriously than most of my competition.  That's why my clients hire me and why I love this job so much.

Judi, you've written a clear, concise explanation about what information might appear on a title report and why we get one as soon as we take a listing. If anything is a surprise or amiss, knowing ahead of time allows time to clear up any discrepancies--so important.
