THE ROGUE REAL ESTATE AGENT........ THAT GOT AWAY WITH IT..........?

I have been watching my gardener with interest lately. He is a most proficient skilled worker, but he carries around a noticeable burden. Everyone has stories to tell and the amazing part is that no two stories are alike. His son approached me one day and said, your a Real Estate Broker aren't you? I said sure....and then he told me this story....

10 years ago, a Real Estate agent approached his Spanish speaking father and asked him if he wanted to purchase a 3 unit residential site. The father happily said yes and..... deposited the monies.

The agent explained to him that he would keep his name on all the paperwork so that there was no chance of the deal falling through. The father, a simple man who knew nothing about Real Estate thanked him and followed his direction and advice.

After the close of escrow, the agent approached the man and had him quitclaim his wife's interest in the property. Now, the deed read....tenants in common as to a 50% ownership with the agent and with a 50% ownership to the father. The father was very grateful to this man for all his help.

Over the next ten years, the father worked day and night cutting lawns and digging trenches to pay off this property. He did so. During that time, he put money into the property and maintained it at his sole expense. He paid all the taxes too.....Not a word from the agent during this time........TEN YEARS......not a word

Less than one year ago, this agent put his 50% ownership of the property up for collateral on a loan he needed to start a restaurant. When he did not pay back the funds, the lender of the money began litigation and filed a partition action to force the sale of the property so he could collect his monies.

The gardener and his family had a tough time swallowing the fact that they didn't own 100% of the property and that their agent had half. They never knew this. They argued that they paid it off with their hard work and sweat. They said they put down all the original funds. How could this man own their property?

The father and the family were flabbergasted and knew not where to turn... or go... or what to do? They ended up giving $5000 plus to an attorney who used the funds to bill for his paperwork and time, but left the case unresolved. The father ran out of money and had to let the attorney go.

The other party became more aggressive when this happened and went for the "kill" and set the whole thing for trial. The father, a simple man...knew not what to do....

The father shows up at the courtroom, but doesn't know he is allowed to enter into the court room. So he waits outside in the hall to be called. He does this more than once. The result: the court finds he did not show up (twice) and grants forward movement to the party trying to foreclose.

They came to me with all the is paperwork and story. I reviewed it and concluded:

Statue of limitation has expired. Your attorney has not remedied the situation, but kept an open billing instead. The property is scheduled toward a successful partition action trial. My Recommendation: Start fighting back correctly or try to settle this. They asked me to help them.........

Long story short....First, I contacted this lender and asked why are you doing this? Strangely enough, he relented and said, he would drop his position and for me to contact the agent (his friend... I learned later). I contacted this agent and asked him to try to settle this. I did not bring up anything else. Just resolution. He was guarded, but intelligent and wanted $25k to settle. When I brought up some truth & fact, he became very defensive and argumentative. I had to back down or negotiations would have concluded. He would accept terms etc. If not, he expressed remorse to have to force the sale, but he wanted his money........I submitted his offer to the gardener and I am waiting to hear from him...at this time

THE AGENT GOT AWAY WITH....... SWINDLING THESE PEOPLE OUT OF 50% OF THEIR PROPERTY...........

I am still amazed at the goings on in the Real Estate business. I caution everyone to over-counsel their position when it comes to the biggest transaction of your life.

Richie:  I fully understand Statute of Limitations, but what about taking this Agent to the Real Estate Commission?  The Commission takes a very dim view of such things and are quick to bring the Attorney General into such situations.  I would certainly hope perhaps one of your local lawmakers/political personalities could be of some assistance.  Oops, didn't acknowledge the 10 years -- still think there has to be some leverage lurking which causes him to become so aggravated. It could be possible he has done this before and the Commission might have a record.  I applaud your efforts on their behalf.

Unfortunately desperate people do desperate measures.  I see it daily where people from other countries that don't understand our system of real estate do get taken for a ride.  ALthough I personally have been taken for a ride by some of these foreigners.  It does go both ways, but I live with a clear conscience knowing I work to the best of my abiility and training.  If it is over my ability I refer it out. Unfortunately we all learn valuable lessons in life that eventually leave us with our guards up!

I agree that legal aid should be hired to take on this case.  It is an injustice that this gentleman has had to put forth so much of his earnings just to get what is owed to him.  That agent should lose his license.

Tish......you are making some good sense. The man is attempting to negotiate while holding the partition impending trial over the head of my potential client. In addition, that 10 years ...RIGHT or WRONG seasons the deal for him. He was toast during the first 4 years which is the statue of limitations. Now, he looks, acts and IS half owner of the property........whew!..........it continues.

How old is the victim?  If he is elderly wouldn't this be considered Elder Abuse?  I cannot believe how heartless some people are.  I wish you the very best in solving this problem for this man.

Ty says... why......some don't trust others who are in authority. It's true. The love of money is the root of all evil. People love money more than God and..... then of course more than people. The results, there is no love in the perpetrator and the wanton rampage of destruction in the name of a "BUCK" .....goes on. Who says that there is no battle going on between good and evil? I am reminded of ex-President Marcos when he fled the Philippines and took 5 billion dollars with him when he fled the country. He put the whole COUNTRY at risk...so he could have money......a dying man without a home hated and scorned by all, but has 5 billion. he got the raw end of it.  Remember too....Mrs Marcos having 5000 pair of shoes? These are poor people indeed and someone said..."we will always have the poor".... Thank you Ty

Heather....good sense comment made by Heather....what price to you put on a clear conscience? Imagine you are on your death bed where nothing makes sense or matters anymore. You don't care about money, or things of the world as you lay there on your countdown to exit. Does anyone really want to deal with ERROR at that point in time? What a horrific way to leave under......now compare that to the one who has the clear conscience and just deals with the exit dynamics and no more......This day is another opportunity to right wrongs and do great things.....Heather....let's hit the heights.....

Donna...probably around 55-60, tired but in good health. Very hard worker. You raise a good point about elder abuse. I don't think that applies here. The ten year period where no one complained (either party) says a lot in favor of the perpetrator.....think about it....thank you Donna for your input......

Thank you Liane for you comment. To answer your question...yes in my opinion it is too late for the ethics investigation. Today, I found out that the Agent is no longer an agent and lost his license for obtaining it under false pretenses. You see, you cannot get away with things, but if you repent, you can learn from them. I am currently negotiating with him and the outcome is not known. One step at a time and of course to believe that RIGHT makes MIGHTS...helps a lot. Best to you

Marte....actually the attorney is just practicingmbusiness along with law. He will do all sorts of paperwork, make motions and through time, money, and effort, try the case. The man in need just ran out of money to play the attorney game. Since I do not make a living by stretchings out and complicating them, cutting to the chase gets me resolutions and results......The attorney is a business man. I understand that. BTW, once he wasn't getting paid, he asked for and received permission from the Judge to be relieved from the case.

John.....it goes on...This is not for beginners and for part-timers. The stakes are high in business especially in Real Estate. Going in with four sets of eyes is always recommended. It is wise to spend money either to make money or to protect money...when necessary........Yes?

Nina.....I am currently in talks to try and settle this. I managed to convince the agent to postpone the trial (last week) with the understanding that the parties would work out a settlement. His latest offer is he will take $18k in cash to settle right now down from $25k.  I just left a message a few moments ago and it is ongoing. BTW...This agent lost his RE license for fraud it turns out (several years ago). I brought that up to him in a polite way and he said it has no bearing on this and it was for a commercial deal he was working on. But it bothered him. Letting ten years go by has seasoned  this rogue agents position in a bizarre way. The gardener was going to have his son handle the trial for him. Neither know or have a legal grasp of the situation. At first glance, they appear very ignorant and it is my hope that it plays into their favor by helping them gather sympathy from the judge. That will only go so far. Ignorance of the law is no excuse. I even told the agent, (who is very intelligent) that when I put them side by side, people are going to see his ignorance and your intelligence. I got a little response out of him on that truth. That's all I can tell you for now.....thank you for your inquiry Nina....
