You Really Need a Certified Copy of Your Property Deed (Not!)

A client of mine recently received a very official looking letter offering  a certified copy of the Deed to his property and a complete Property Profile for a processing fee of only $87.00 !!!

Nationwide scams like this have been around for several years. 

The letter makes you think you must have a certified copy of your Deed in your possession.  This is not true, that's why Deeds are recorded or filed - to create a permanent record of the real estate transfer.

Even if you wanted a certified copy of your deed, there is no need to overpay.

Check your closing papers, you might already have the original recorded deed in your possession, if not:

•1)      You can receive a copy of your recorded Deed for a nominal fee from your County Clerk's office and for a few extra bucks they will certify it for you.

 

•2)      When in doubt, check with your Real Estate Agent, Closing Attorney or Title Company for information about your Deed; they will know how to get a recorded copy for you.

 

 •3)      a  recorded copy of your property Deed  should cost you very little or nothing and while not necessary (providing it has been recorded)  it's a good idea to keep it with all of your other important documents.

 

About the Property Profile that was offered :  You should have received a Title Insurance Policy, copy of all the covenants, plat map, any surveys, tax and assessor information...you already  have all of the documents from your closing, including a copy of the Mortgage Document or Deed of Trust,  and a copy of your Deed, what else could be in a Property Profile?

 

As long as there are new buyers there will be people getting these very official looking letters.

 

Don't spend your hard earned money unnecessarily. ..Steer away from any company that offers to do this for you for such a large fee.

There is never a need to overpay for this document.  In GA, the buyer receives a copy in the mail from the closing attorney's office once it has been recorded.

Mary, it's amazing the scams  created just to bilk unsuspecting people. Though not "illegal" they are very deceptive. In Austin, every year folks get letters from companies offering to file a Homestead exemption for $30-$50 when all it takes is a free foe available on the internet from Travis County, and envelope and a stamp!

Hi Richard, I agree with you - there is nothing illegal about it, and the letter is very misleading which is probably why many people would pay outrageous fees for such a service.

 

Terry, that's true here too.  Most homeowners should already have the original recorded deed mailed back.

Hi Ruth, it does make you shake your head doesn't it?  People sell all kinds of things we don't really need, but some don't know there is a much less expensive alternative!

 

Hi Chris, I've heard that many counties have copies online for free!  We have to pay at our county but the fee is $1.25!

As a person who has worked in local government for more than 30 years and been involved in real estate market this same period of time, I am amazed at the amount of free or minimal cost information that gets re-packaged and sold, especially over the Internet.   Your posting is an example of where a potential consumer should ask questions about whether or not they need the item offered and if the answer is yes, what alternatives do they have for securing the item at a lower price (or free!).

Great Post and comments...In Nebraska, you receive it in the mail about a week after closing and it has been recorded.  You can get a copy for a nominal fee..

Thanks Bruce, I think my Once Upon a Title series has ended - but I might hear about some juicy new claims and write about them - you just never know!  I heard about an interesting snafu the other day, but it might be too local to report it here.   Hard to believe I have been away from the business for almost 3 years!
