DO THREATS REALLY WORK? MAYBE...........

I have been working a short sale since January (I have the Seller).  All the usual pain and aggravation.  Almost no communication from the Lender, lost files, disputed appraisal etc.  Had a good offer submitted in March. The Buyers are totally APPROVED, represented by a great Agent and are very patient.

Foreclosure signGuess what?  The Lender could care less.  They countered OVER the disputed appraised amount.  We tried to appeal the appraisal, with the appraiser's blessing.  No dice. We are headed for the courthouse steps next month.

I made the dreaded phone call to my Sellers Thursday afternoon.  Had to tell them my bag of tricks was empty; that unless we came up with another offer very close to the Lender's last counter, we were out of luck.

My very smart Sellers had another idea.  They googled their fingers off and found the name of a customer service VP of the Lender.  Friday morning they sent a well written email asking to talk with someone to review their file with them.  If they didn't receive a response, they would be forced to contact the consumer advocate reporters for the local television and radio stations.

Lo and behold, within one hour the VP had phoned my Sellers and me, collecting all the pertinent details.  He gave me his personal phone and email.  We exchanged information and docs all day.  Although he made no promises, I feel we still have a fighting chance.

 

Who knows?  Maybe threats do work..........

Wow, Tricia!  Sounds like a good one!  I may have to borrow this one from you in case a future short sale goes awry... Thanks for the post!

As I was reading the post I was going to make the suggestion of contacting the head of the department. I was surprised as I read on. I would say that was a few steps up. "Good job clients".

Good Luck Tricia... banks can be tricky - and of course you have to hope their employees are all having a good day. A associate of mine had an issue with a bank when the home in question was located in an affluent neighborhood..The homes surrounding this particular home were all selling for great prices, in good conditon and selling for some $200,000 more... this home was in terrible disrepair, but when the bank conducted their electronic search, they clearly saw the other homes were selling for higher and declined the short sale based on that not accepting the BPO. In a situation like that, prior to my associate being declined the short sale, it would have behooved the sellers to have had an appraisal, after having their home listed at a higher price (which I am sure you did) for 60 days or so prior to receiving the lower offer ....which would have clearly pointed out that the home was offered for more, you had tried a higher price point, and the market is telling them it is valued lower. I wish you luck in the process. It must be very frustrating for you , your sellers and the buyers. Best, Gay

Banks are definitely the villain of the day. And that customer service VP was smart to smell the potential for more blood in the water.  Good luck!

Threats work if you are willing to back them up. If you make a threat and then they call your bluff and you don't follow through, you have lost your credibility on top.

Thanks so much for the comments.  Believe me, my Sellers have been to hell and back with this one.  They are definately willing to do all they can to make this work.
