I have a home builder client who aggressively markets to the Hispanic community. 

His marketing was doing very well and about six months ago, he asked us to help him get a loan product that would allow him to sell homes to people without social security cards but who had Individual Taxpayer Identification Numbers (ITIN). 

We went out and found the investor bank who would do this.  Recently, that investor announced they would allow these loans up to 100% in many cases.

ITINs were created for foreign investors and other visitors to the U.S., who owe taxes, but are not eligible to get a social security number. 

Many illegal aliens have gotten ITINs.   This allows them to file taxes legally in the U.S, even though they may not have the necessary immigration status.

This number is issued by the IRS for tax purposes only.  The ITIN holder does not have the right to live or work in the U.S. because they have the card.  However, it does give them a way to buy a house.

According to recent reports, this is potentially a $44 billion market, especially in the Hispanic community.  There are approximately 11 million immigrants who are undocumented.

This is a huge opportunity for you in today's market. 

Certainly, those who oppose illegal immigration will oppose this as well.   And there is a lot of controversy on this topic.   

However, there is no arguing that this niche provides incredible potential today.

The providers of these loans say the default rate is consistent with all other loan products and this is no riskier.

For the record, the banks that do make these loans are not suggesting that they are giving these loans to illegal aliens.  What they are saying is that these are for "undocumented" immigrants and they are not required to find out if someone is here legally or not.   Sure, it's a loophole but its one that they have been running through for some time.

For a long time banks have allowed clients to open checking and savings accounts using matricula cards (an official Mexican I.D. card) and offering money-wiring services to undocumented immigrants. 

Some of these banks have even offered car loans and other personal loans by using the matricula card.

There are some strict rules to these ITIN mortgage loans. 

These loans require that you fully disclose your income. 

The loan amount should not exceed $300,000. 

The rates will be in the mid 9.000%-11.000% range and will not be interest only but they don't require mortgage insurance.  

100% financing is sometimes available but 95% is much more common. 

For many years, before this program and even today, immigrants have bought homes where the seller carries the mortgage on a contract for deed.  

This was and is a risky deal because sellers don't always live up to their end of the agreement.

Today, there is a real option to homeownership for those without social security numbers and to those of you who successfully market to this niche.   

The bottom line is... The American dream is achievable, even if you are not yet American.

UPDATE:  I got so many private emails about this blog and if it available in your state that here is the list of prohibited places to date:  WA, NY, RI, MD, DC. Orange & Jefferson counties in Texas; Dade, Boward, Coller & Monroe in Florida.

UPDATE #2: 08/21/2008-- As has been happening a lot in the credit crunch, the last bank in the U.S. doing ITIN loans announced last month they were not doing them anymore.   If I hear about a new bank starting up again, I will add it here.

I have some concerns with this which are becoming more relevant with the sub-prime fallout going on now. Is this type of lending responsible? Are there any long term drawbacks that are forseeable?

Andrew--- Your concerns are legitimate.  I talked to my rep at this investor and he tells me that the default rate is the same, if not less, as it is on their other products. 

These buyers, he believes, are thrilled to get the opportunity of homeownership made available to them and they respect that opportunity.

This is the first time I ever heard that banks will do such a loan. As an accountant I have work in IRS for several years and I know that ITIN is issued for tax pirposes only, but I never heard that banks will create a ITIN loan, well what to say if IRS can why banks can't.

Larry--- Its certainly not cheap.  However, I believe that the borrower should always be presented with all options available and this is the only one.  It may not be cheap but at least its an option.  That's why the loan amounts usually stay pretty low.  Most of the ones I have done have been below $200,000.

Regardless, of what  side you are on for or against the issue of  immigration. There are millions of people working day today in the United States they are no diffrent than you or I. They still aspire to obtain the American dream. It may be a high interest rate or an expensive loan to obtain. But,  coming from immigrant parents who where illegal at one point long ago. They would have jumped at the chance to get a home. This oppurtunity was not there but they managed to buy. This is why, I never stand in the way of a determined person illegal or not if their desire is great enough and their will strong they will achieve .In this case the American Dream is a little closer, for all .....

Mario--- Without mixing too much politics into this discussion, I could not agree with you more.   My father used to tell me the fascinating story of his father, my grandfather, who as a boy had a dream to leav Europe and come to America, when his mother died.    

 He paid to get him and his brother smuggled onto a boat.  The boat was actually going to South America instead.  So he spent his youth in Argentina until he could afford another trip to America. 

I believe that most of us have "Coming to America" stories.  Its important that we don't lose sight of our ancestors who created and lived the dreams we take for granted today.

There are many hard-working people here today who are not citizens but who love and respect this country, and its opportunity, much more than their neighbor whose family has lived here for many generations.

I agree.  Those people deserve the chance at homeownership.

We call this a foreign national program and it is expensive, but it has allowed 4 of my clients to buy the home the desire now as they are working on their status.  These are not loans for the faint of heart, do they have credit under the ITIN or under the "fake" social.  There are many differences in this loan than your conventional loan

Joe--- Great advice!  The other warning people should know is they usually take some time.  I have never seen one close in less than 30-40 days.   However, I have seen some people who do have actual credit under their ITIN number.

Aaron, I was not aware of this. Since our laws for becoming a citizen have heightened since 911 it is very difficult for the immigrants to get citizenship which made it virtually impossible to obtain a home. Did I miss who it is that is able to give loans without a Social Security card and other documentation? It would be good to know who offers these programs under $300K. If I missed it, sorry.

Aaron: Have you done an article about lender owned properties around Las Vegas and the challenges getting investors financing? I for one, would love you to write this blog. I hear rumblings from my California investors that there are lender owned properties being deeply discounted. They seem to be ready to pounce on them. What is the market like there? Is this true?

Gina--- The IRS issues the number.   There are a handful of banks who offer this product.  If you have someone you want to qualify, let me know.  I have done a ton in California.

 Janet---No, you can be a U.S citizen and buy there now.  The rules are a bit different but it exploded during the last rush with second home buyers from the U.S.   I believe you can only own it for 50 years and then your survivors can for another 50 years.  It goes into a trust.  Great blog subject for someone to touch on who does loans there.  Unfortunately, I never have but maybe I will research it and tackle it.  :)

Regarding the amount of REO properties in Las Vegas and the discounts, I actually did write a blog on it a month or so ago.  "What to Really Expect When Buying A Bank Owned Property" 

However, I think another blog on those values would be great.  I am going to do it!!!  There are a ton of great values here now in the REO market.

An agent that specializes in REO's around Las Vegas ( Countrywide"s) was on the phone with me last night.

Some of the stuff she was telling me about lenders losing their butt there was shocking. No wonder CW needed an infusion.

Please include this in your blog: does the lender selling the house want to carry the loan themselves? Again? Or do they just want to make sure the buyer is solid?

Brian Brady says we should all be looking at investors as the ones who will be buying in this environment. What do you think, Aaron? I bet Brian knows something about buying property in Mexico. He is in San Diego!

I am in Utah & know that I have access to a lender that does mortgage loans using the ITIN.  What about loans for mobile homes?  Is there any lending agency that will finance (most likely a type of personal loan) using the ITIN?

Wouldn't an illegal immigrant be weary of applying with the IRS for an ITIN??  What exactly is this process??

I am a Loan Officer & Financial Advisor.  I learned that if a person has a "Tax ID Number", they can invest in any financial product including life insurance, IRA's, & 529 college savings plans.  I have been trying to break into this market more.  Many immigrants welcome the idea of a United States savings plan for their kids to go to college.

Floyd--- I believe you can.  I dont do those kind of loans however.  Ask your local banks.

Sirilo--- yes, these loans are available on foreclosed properties.  However, these loans take up to 60 days to get and the bank will take that into consideration when you make your offer and not like the timeframe.

Me and my boyfriend who has an ITIN number just bought a house. I am a american citezen but he isn't. Does the first-time homebuyers apply to both of us? I can't find anywhere where it says that about unmarried illegal home buyers.

Hi , this is a great column, i did buy a house using my itin, that was 4 years ago, my interest is 7%.

My question is: wish bank will refinance my loan?

I tried bank of america,citibank, ect, but i need a ssn to do so. does anyone here knows a bank or finantial institution who will help out to get a better rate? thanks
