Today is The Orange County Register there were two articles on loan modification attorney that was disbarred. Brian Colombana a Laguna Hills attorney admitted extensive misconduct that will result in his being disbarred according to the State Bar of California. He stipulated last week that he committed nine acts of misconduct.
This attorney did not achieve a single loan modification with a single client. Can you imagine a bigger failure not one client got results but paid a fee for his incompetence. Many of the clients that Colombana was working for were in states where he was not licensed to practice law. He also admitted to engaging in a scheme o defraud these client for personal gain.
The companies he was associated with were Loan Negotiators of America, Housing Law Center and Mortgage Relief Law Center. His associates advised them to stop making their monthly payments. Many of these people had been current and fell behind and some lost their homes. Many of the people were worse off due to their hearing of the firms above. I really hope that Colmbana a loan modification attorney gets more than being disbarred.
Loan modificationis not working on so many levels. Few ever get them many of the attorneys locally have been disbarred or have given up their licenses. The banks do not have to do them and the Administration has promoted them from the national stage. If people did not believe in the false hope of loan modifications they would be able to keep their homes and know there is nothing better. Or if there is a hardship they could do the short sale and be done.
I believe that what is happening in this issue as in many issues on the American stage to day there is to much uncertany. Uncertany causes the banks, homeowner and the public to head down false trails to dead ends that have major consequences to the individual.
Mr Colombana is an attorney out for personal gain and is a bad guy. He is not the first or the last but the government does not need to help him by a lack of a clear and effective guideline that is specific and enforceable.
