OK This is my 1st Blog and it has taken me such a longtime to get my pen moving! Here Goes......

At first most agents would say Of Course!

 ...that's because you assume you met a buyer who called on your sign or met @ an Open House and they have decided they Loved your listing right? Well yes if your state allows Dual Agency...IF your buyer does not mind ...OR if your sellers said it was OK for you to do DUAL AGENCY! Right Of Course you should be able to write an offer on this home....the GOAL is to sell your clients home.

BUT,what IF you are a  Buyer Agent who has been showing these buyers homes and they fall in love with a home that the listing agent also loves !..... Scenerio: your buyer drives by this home..goes home and a few hours later picks up his/her phone and calls the Listing Agent w/ only 1 question( innocent right?) If answer is acceptable,they will then call YOU their Buyer Agent. In the conversation w/the Listing Agent ,he/she says Oh I am looking at it as an investment possibly and proceeds to discourage the caller on the merits of this home...You now have inside information maybe??

Interesting: Who is he/she working for ? the seller(supposed to be) OR maybe himself???

Dilemma:  I called sellers to make app't for 2nd showing ...I'm told contract came in 2 days ago ....Would you ask him/her if the contract was from him/her since you have inside info or not?

Sadly, there are many agents who

know the rules but don't follow them

know the rules but don't care about rules

know the rules but think only of their own interests

I've met them for more than 25 years.  Nothing has changed.

Why am I surprised ?...I too have been in this business over 20yrs

Yet everytime ,I come across agents who do not follow the Rules...I am shocked and saddened

...but who is the ultimate loser? Our clients and our industry..

Yes , Dual agency is not as easy as many think!

Another question...how do you get those symbols under your picture(and I have been trying to add my picture for some time....UGH

Bev-the symbols come from your participation on Active Rain.  If you hover over them you will find out what they are for.

I wrote a post on this subject awhile back when a buyer contacted me distraught when they learned "their" agent turned out to be a competing bidder on a property they were interested in buying.  They were not happy campers.  There are a lot of lines that are being crossed these days and all you have to do is read the DPOR site to see the number of agents being cited for various violations to know these are not the best of times.
