This coming November 2, Arizona voters will be ask to make a decision on the Medical Marijuana Initiative. The initiative allows people with a debilitating medical condition to Purchase or grow, possess and use marijuana.

Points to Consider:

"Legislation seeking to decriminalize and/or legalize marijuana reduce the perception of harm...States which have Implemented "medical" marijuana ballot initiative have of the highest addictions rates in country."

What the initiative allows and points for voters to consider:

* Medical marijuana dispensaries created through this initiative will be not for profit.

* Points to consider:tax exempt. According to the initiative, no tax revenues will be generated.

* Doctors are required to conduct a full patient exam and medical history.

* Points to consider: exams: Nothing in the initiative states the exam or medical history is conducted in-person.

* Az Department of Health Services can issue cards to individuals under the age of 18, with certifications from two physicians and the parents/guardian. Risk must be disclosed.

* Points to consider: allow children to use: Parent/Guardian control dosage and frequency of use. There are risks associated with brain development and learning.

* Allowable amount of marijuana is 2-1/2 ounces every 14 days.

* Points to consider: how much is allowed: That equates to 140 joints or ten joints per day.

* Number of licensed dispensaries in Az will be limited to a 1 to 10 ratio of licensed pharmacies, equal approximately 125.

* Points to consider: allows grow your own: If a patient resides more then 25 25 miles from a medical marijuana dispensary, they are permiited to grow their own, up to 12 marijuane plants.

* A registered medical marijuana dispensary or its agents is noot subject to prosecutions, search, or inspection, except by the Department of Health.

* Points to consider: who inspects: The only autherorized agency allowed to inspect a medical marijuana dispensary or self-grower is the Department of Health Services " and shall give reasonable notice of an inspections."

*VERY IMPORTANT PART: NO SCHOOL OR LANDLORD MAY REFUSE TO ENROLL OR LEASE SOLELY FOR STATUS AS CARDHOLDER ( UNLESS FAILING TO DO SO WOULD CAUSE THE SCHOOL OR LANDLORD TO LOSE A MONETARY OR RELATED BENEFITS UNDER FEDERAL LAW).

* POINTS TO CONSIDER: landlords and schools: Discrimination prohibited for medical marijuana use.

* Employers may not discriminate against a person in hiring, termination, or imposing any terms or conditions of employment based upon either a person's status as a cardholder or a positive drug test for marijuana components or metabolites.

 * Points to consider: employer rights: Affects drug free workplace and employer safety/liabilty issues.

* No registered cardholder may be denied custody for visitation or parenting time with a minor, and no presumption of neglect or endangerment.

* Points to consider: children: No requirement to protect children from marijuana exposure.

* THE INITIATIVE STATES THAT IT IS LEGAL TO OPERATE A VEHICLE, MOTORBOAT, ORAIRCRAFT "WHILE UNDER THE INFLUENCE OF MARIJUANA."

* POINTS TO CONSIDER: DUI marijuana metabolites allowed: Initiative adds that registered qualifying patient shall not be considered to be under the influence of marijuana solely because of the presence of metabolites or components of marijuana that appears in insufficient concentration to cause impairment.

This initiative was brought to Arizona by the Marijuana Policy Project (MPP), a Washington D.C. based organization.

Points to consider: legalizing marijuana: MPP has many campaigns across the U.S. including "lobbying and building coalitions in support of ending marijuana in California.
