Verbal promises are very common, but what counts in the end is what's in writing and what you signed and agreed to. You have no leg to stand on in court if the verbal promises were broken but you signed the contract witch stated something other than what you were told.

Good advice for financially trouble home owners. Still, the statistics show that over 60% never call their lender. Calling the lender for options should be the first step. Never pay front end fees for promises to resolve the problems.

Hi Roy,

I agree with you to some extent. It is true that the homeowner should contact the lender for options first. But unfortunately a lot of times the lenders will put off the homeowner due to them having too many files at once to work on. An Attorney will get priority and the case will move along fairly quickly. I also agree that the homeowner should not pay upfront fees *if* they did not hire an attorney, but some other third party negotiator. Attorneys charge retainer fees upfront.

My question about licensure goes to MD law.  No entity other than an attorney may charge an up front fee for services OR FOR REFERRING a consumer for mortgage modification advice.

Hi Lenn,

 

You are exactly right. There are quite a few states who have implemented that law, which protects homeowners. The Law Firm that I work with can assist folks in MD as long as they have their loan with a national lender. They do charge an upfront retainer fee that is placed in an escrow account, once the file has been excepted. The review of the case is free to the homeowner.
