STUART — A division of a nationwide home builder has filed a lawsuit charging a local company with supplying and installing defective Chinese drywall. In a breach-of-contract suit filed last week in Circuit Court in Fort Pierce, Delaware-based KB Home Treasure Coast claims Gateway Drywall Inc., a division of Gateway Building and design Corp. of Stuart, “supplied KB Home with gypsum drywall that was manufactured in China ... and installed the Chinese drywall in residences constructed by KB Home in Orange County (Fla.)” KB claims the drywall “is defective because it is emitting gases that are negatively interacting with other elements where installed, causing damage to the subject homes and other property, including but not limited to (heating and air conditioning) coils, certain electrical and plumbing components and other affected materials.” KB claims it has begun “repairing and remediating” the damaged houses. The suit does not specify where or how many houses were built with defective drywall from Gateway; nor were specifics of the contract — how much drywall Gateway supplied and at what cost — listed. The lawsuit does not seek a specific amount of money but asks for “damages in an amount to be determined at trial.” The case has been assigned to Circuit Judge William L. Roby. Messages left Monday afternoon at Gateway were not returned. Cara Kane, a spokeswoman for KB, said the company does not comment on any on-going litigation. According the federal Consumer Product Safety Commission, 2,069 homeowners in Florida and 3,602 nationwide have filed complaints about Chinese drywall. Government testing has found that some Chinese drywall emits hydrogen sulfide, causing corrosion in air conditioner parts and plumbing. Some homeowners have complained of health problems, usually often breathing difficulties, because of the drywall gases; but a definitive link has not been established.
