As homeowners attempt to prepare their properties for the fire season, rumors are flaring throughout Lake County that have sparked confusion regarding the specifics of the lot-clearing permits.

According to Ron Yoder, Lake County resource planner, there is no permit required for lot clearing, as long as the soil is not disturbed. "If all they were going to do is use a chainsaw to cut vegetation at ground level, no permit is needed. However, if the lot is 30 percent grade or higher, or if 10,000 cubic\ yards of material is to be moved, then a grading permit is going to be required," said Yoder.

A spokesperson for the community association said that most of the lots in the northwest of the subdivision have been successfully dealt with. New letters are going to be issued within the next few weeks to inform a new batch of property owners that their lots are in violation. "Due to the fire hazard caused by overgrown trees, brush and grass, we are requiring that the lot be trimmed back or cleared in order to come into compliance with our CC&Rs," said Bob Frane, who volunteers his time at the association office.

California law (PRC 4291) requires property owners and/or occupants to create 100 feet of defensible space around homes and buildings, according to a pamphlet produced by the California Department of Forestry and Fire Protection. The department recommends that the first 30 feet around your home be a "lean, clean and green zone" and the remaining 70 feet be a "reduced-fuel zone."

Insurance companies are getting stricter on the fire setbacks since the Oakland Hills fire. "Farmers Insurance requires a 200-foot setback; some companies require a half mile," said Maria Messimer, a Farmers insurance agent, located on Main Street in Kelseyville. "Dozens of homes are being cancelled because of the new fire-line rules. We can still insure them, but in many cases, the fees are doubled."

The Clearlake Riviera Community Association (CRCA) is sending out formal violation notices. "If the notice is not addressed by the property owner, there will be a request to appear at a hearing before the Board of Directors. They can fine the homeowner $250 per month until the property is brought into compliance," said Vallen Cooper, CRCA property manager. "You can pick up the weed-abatement guidelines and a list of lot-clearing contractors here at the association office.
