                              Have we all hear the old saying "If it ain't in writing it ain't" !  

                                               this is the one that is worth repeating.

  I had a closing last week yeahaaa!!  It was a longest and worse closing I ever had (and I had some good ones trust me). Summary it went over 48 hours and if you wonder what went wrong you name it!

 What I actually wanted to talk about is one of the issues that we faced. I was a buyers agent and it was a cash deal little more on your shoulders since there isn't a bank involved and its all you. We where said that there is a contract for termite treatment in place and my buyers, against my advice, decide not to get inspection but instead they will pick that contract up. Not very smart but we have seen it before.

   At the closing table we ask for the proof of the contract as for obtaining contact info and listing agent doesn't have one. She didn't realize that we would need one?!

   Still cool lets just call the provider and have them fax us something....

Yes you got it, there is no contract! I can't believe I was there doing the inspection in the very last minute just because I have assumed that listing agent knows what is she talking about. Once again GET IT IN WRITING!!

I'd suggest you let the buyers get their own inspection each time.  I can't tell you how many homes have had active termites even though they were under "a contract".  One of my sellers had to actually fight with the contract people for a treatment - because they didn't "see" the termites when they inspected and they wouldn't complete the repairs. 

Real estate must be different in NC - if I have a cash deal it is much easier!

If you will do it or it is true, the party will write it down and sign it.  When signing a contract, I tell all parties as they sign if something has been promised them that is not written in the contract to speak now or forever hold your peace because if it is not in writing it is not enforceable.

Definitely get it all in writing. Unfortunately, many verbal promises are just so much hot air.
