If you are going to lie to me....may I suggest you take more care before you send emails? I might get one you didn't mean for me to read......ooooooops! :)

I've spent the last couple days listening to the sob story of a buyer's agent telling me that the reason his client needs to cancel our escrow is because of a job loss. We are 2 weeks from the close and contingencies have been removed. My sellers are wonderful people who have bent over backwards for this buyer and have been conflicted about asking for the deposit.

My sellers have now been placed in a difficult position financially, they have moved. They were counting on all going smoothly to the close...we had loan approval and they had made repairs as requested, all contingencies have been removed.

The buyer's agent has sent email after email begging us to be compassionate with his buyers. That this is all the money they have and now he's out of work. My sellers have been thinking about this and were leaning towards just releasing their deposit and hoping another buyer comes along...we have no back-up.

But then today.......and email arrives. I've been copied on an email to the buyer's lender:

Dear Blank,

Any news on the new property? I have sent you the escrow information and we would like to get this moving as quickly as possible. The buyer is very excited about the new home. Did you see that the sellers are paying for closing costs? Isn't that great? I am getting a commission bonus on this too....so it's a great situation.

Let me know as soon as you have any news for me or if you need anything. Let's try and get this done quickly.

Dear Mr. Lying Real Estate Agent and Lender,

I'm delighted to find that Mr. Buyer did not lose his job after all!!! That's great news!

I just wanted to make sure that all parties are aware that the sellers are going to require the deposit we have in escrow to mitigate their damages. I hope the buyers weren't counting on that for the down payment on the new property. Although it won't compensate my sellers completely....it will help.

Good luck on the new home.....too bad they didn't want to conclude the purchase on the original one, I'm sure the sellers would still be happy to work with them.

Karen!!! Stop it!  Oh my, what a lie you were given.  These are the types of agents that need not be in the business, first they need to explain to their client that they have removed contingencies... wow, speechless.  Loved your response!!!

Wow! What was that agent thinking? seems pretty easy to verify if its true or not. A contract is a contract and kudos to you for handling it the right way. It seems the seller is in a good position to sue. But then everyone looses. If the buyers agent would have explained the law to his client. neither of them would be in this situation.

I just love your response and the fact that the buyers and their agent got caught.  I hate it for the sellers though.  Glad to hear in the update that there is still a chance that the sellers will get the closing that they needed.  Sometimes the good guys prevail.

Wow... That agent really doesnt get it. Doing unethical things like this will only hurt their career in the long run. I always feel that honesty is the best even if it isnt in your best interest.

Ahhhh, never a dull moment in our business!  that's why words are worthless, because you cant trust them... you need EVERYTHING in writing as proof.... Many of us have had clients lose jobs mid-deal.. .and it is a horrible thing and you do everything you can to help them....  But to lie to get out of a deal is horrible.

HA! HA! HA! I guess that Buyers agent should have listened to the other golden rule "It doesn't pay to lie" since he ignored the first golden rule "Do unto others as you would have them do unto you."  To be a fly on the wall when the buyer found out what their agent did and to hear what the broker had to say.

Wow, that's unbelievable.  How embarrassing for the other agent...and what a jerk!  He should absolutely hide his head in shame the next time your paths cross.  It will come back on him...it always does.
