Check out the article below.  It is amazing that this could happen in this day and age.  An absolute insult and he should be able to recover some damages if he wants to spend his time pursuing it.  I know Bank of America owns practically everything, but they don't own this guy's house!

Just when you thought you have heard them all! This one really had me wondering again, what planet are these lenders from? We should have a contest for the lender who does the most stupidest thing and award them a huge booby prize! fort lauderdale foreclosure story


John Grodensky bought his new home in Fort Lauderdale Florida in December of last year. He paid all cash for the property. He did not get a mortgage. Bank of America approved a short sale with the previous owner and accepted and received wired funds at the closing. The sale was also recorded in the Broward County clerk records. 

Boy was he surprised to find out this past July that the title to his home had been turned over to a government backed lender. He was scared to death to find out he had lost his home in a foreclosure that he never even knew about. 

The foreclosure case had continued in the courts and in July the foreclosure sale took place and the recording office transferred the title to Fannie Mae. 

And what about the culpability of the attorney involved in this blatant illegal foreclosure? Attorneys are being investigated in different cases. The banks are not communicating with their attorneys and the attorneys are not communicating with the courts. It is a mess. 

Bank of America has conceded to the mistake and said they will fix this problem with their own money so that John does not have to pay for the cost of their error. 

The biggest problem is that when a mistake like this happens and this is certainly not the first of these to happen, it is very expensive, time intensive and complicated to undo a foreclosure. 

When John found out that his house was no longer his house even though he paid for it, Bank of America did not return his calls, did not help him with his situation. Of course, they did not help until the news got hold of the case. Also, the foreclosure attorneys, the Florida Default Law Group also did not answer his questions. 

So if John had NOT gone to the Sun Sentinel would his pleas for help still be unanswered? 

Bank of America stated that this was an error in communication between them and the default attorneys at the law firm. But that does not help John that much at this point.

Banks can get away with this stuff because they regulate themselves on an honor system, plus even when proven to be in error it is cheaper for them to pretend the problem is someones elses.

When you can buy politicians you can do pretty much anything you want.

the banks are out of control and they have been for a long time.  The rush to foreclose on everything has turned the bad market worse.  If they had slowed down to actually do their jobs for each home situation, we'd have fewer issues like these and less inventory on the market.
