I hope everyone is having a good weekend.  I can't wait for some fall weather to move in.  I recently closed a rather difficult deal on a modestly priced house.  In the end the listing agent never fully read the purchase agreement to the seller.  Seems the seller removed items that were in the agreement.  When this was brought up before the closing the agent hadn't even realized this.  To make a long story short, the agents (myself and you know who) agreed to escrow some funds.  The seller was to return the items and the money would be released to us later.  Well the seller never returned the items to say the least.  I finally decided to release my half to the buyer after a month.  The listing agent wouldn't return phone calls from the closing attorney or myself.  I even had the buyer give it a try.  Finally he called the managing broker who took about a week to return his call.  She told him that since I didn't put a date on the addendum this could go on forever.  My buyer promptly told her what he thought of the agent and what she said.  She still held her ground.  She did agree to have the money released to him. 

Anyway I realize I will date all of these forms next time.  I figured this agent would be reasonable but I guess not.  To have the managing broker bring this up is a joke.  I bet if she was the buyer she would have screamed her head off by now.  The real problem was the listing agent not carefully examining the purchase agreement from the start.

John,  I am looking at your skill in solving a big problem.  You did an excellent job!  Your Buyer's didn't have to close, since the Seller chose to not follow the signed agreement.  That agent should be very grateful to you.  I am sure your Buyers will remember your care to them.   Always work by the Golden Rule, you never know who will be on the other side of your next transaction.

I don't think Mr. Neil the closing attorney would play with this broker or seller to long. They have a point about the date but Closing attorney (my understanding) do not want this money sitting in their escrow for very long. The seller's agent was one of those who don't return phone or email and I get the feeling they get it from their broker.
