Another Short Sale Question for Listing Agents

I have a long list of questions for Wellington Florida Short Sale Listing Agents, which I always ask prior to even showing their listing.  Why?  I want to make sure I am not wasting my buyer clients time or mine showing a short sale that is no longer available or most likely will not close.

wellington florida short salesMy standard questions have always pertained to the status of the property along with who the lien holders are.

However after a recent transaction I have now added ANOTHER question to my list, "Is the Seller current on their Homeowners Association Dues?"

If a short sale seller is not current on their homeowners association dues there is a good chance the homeowners association has put a lien on the property thus becoming another lien holder.  So instead of the bank(s) possibly being the sole lien holder(s) there is now an additional lien holder who might make the short sale approval process even longer especially if the seller owes a large amount.

Yes, I'm finding this too....and the problem is that we can tell our sellers to pay the HOA, but at the end of the day, they often don't care. so.....it's a great question and one we need to prepare our buyers for...possible liens

   I see this all too often. I know that there are banks that refuse to foreclose on properties in certain neighborhoods because they dont want the burden of the HOA dies every month if they take over the property. I am finding HOA's that are going directly to renters to collect HOA instead of the renter paying their rent to the landlord as well. This is a great question to ask!!

Karen - You are so right.  I've encountered several sellers who claimed they were paying their dues, but weren't.  They didn't think being behind $500-$1,000 made a difference, but after you tack on attorney fees, late fees, processing fees, etc. it becomes a big deal.

Joe - I've heard of a few communities doing this
