Ralph Holman, the Associate General Counsel for the National Associations or Realtors is a Baboon. So is Katie Raynolds.
Here is Mr. Holman's Cease and Desist letter telling me to stop telling everyone that NAR leaked over 1 Million email addresses from their non-public database. I told him to go to hell and fix the leak.
Meanwhile on Inman News' article NAR restricts access to members' e-mails about NAR changing how they store email addresses and them reviewing their system because of my complaints, they stated: "We identified some evidence that earlier this year such access had been used improperly, and immediately terminated the account that had done so."
After 5 years of complaining, they finally listened!
Well I call that a pretty crappy system that lets a member download 1
million email addresses to resell them to a spammer. I also call that a LEAK.
Here is the letter:
Mr. Llosa:
I am sending you this message in response to various
messages you have sent to members of the staff of NAR, as well as the Virginia and Northern Virginia Associations of Realtors®. In your messages and elsewhere, you assert that NAR “leaked”, sold, or otherwise made or allowed your email address, and that of other NAR members, to be available to spammers. You have also claimed that NAR, and the NAR legal department in particular, knows that the data is being leaked by an employee, that NAR has acknowledged an “ongoing leak” of member email addresses to spammers, and that you have written proof of some or all of those claims.
In short, your assertions are not true. NAR’s database containing member email addresses is protected by security measures consistent with high industry standards. NAR is not aware that the database containing those addresses is being leaked; indeed, as a result of the security measures by which that database is protected we believe that the database is not accessible to anyone other than duly authorized users, and we have never admitted otherwise. Moreover, at no time did NAR acknowledge any NAR employee to have leaked or otherwise improperly distributed that database, nor are we aware of any employee having done so. Simply put, no leak of the member email database exists. For that reason, we urge you to stop seeking to have VAR and NVAR terminate their routine practice of making their member data, including member email addresses, available to NAR for inclusion in our database.
With respect to your claim of “written proof” verifying the accuracy of your statements, we request that you share copies of such documents with us for our review. To the extent you do not have such written proof we request that you stop making such claims. Moreover, we believe these false claims you have made, as described above, are defamatory of NAR, and we demand that you cease making such statements.
Finally, in the event you believe any additional correspondence in this matter is necessary, I respectfully request that you direct it to my attention, rather than to other members of the staff of NAR, or to its volunteer leadership.
Ralph W. Holmen
Associate General Counsel
(emphasis added)
--------------------------
For those of you that are curious, my "written proof" was referring to Ben Martin a VAR employee that wrote (ie written) to me:
"I talked with the attorney handling NAR’s investigation into the leaked e-mails. She said they have identified a potential source of the leak and are taking action." I believe he was referring to NAR attorney Katie Raynolds.
Hum, sounds like written proof of a LEAK, told to me by an employee. Turns out Ben was correct once NAR admitted to Inman about the... (insert word of preference).
But now Ralph Holmen and Ben Martin, and Scott Brunner all ignore my emails.
And to a lesser extend, so does the Northern Virginia Association of Realtors (hi Jill).
So much for a huge THANK YOU to Frank for fixing the 5 year LEAK.
Ungrateful bastards.
Frank
