New Real Estate Laws in California - 2011

Effective January 1, 2011 there are new requirements for smoke and carbon monoxide alarms. State code, and many municipal codes, like Palo Alto's, will require:

  • smoke detector and wisps of smokecarbon monoxide alarms in most dwellings that have gas burning appliances or attached garages
  • photoelectric smoke alarms

These will be required at time of sale or transfer of title, and in all rental dwellings.

In new dwelling units and remodels where work exceeds a $1,000 valuation:

  • photoelectric smoke alarms must be installed at each level, and in each sleeping room
  • when gas burning appliances or an attached garage is present, carbon monoxide alarms must be installed on each level and immediately outside sleeping rooms

This information was provided by the City of Palo Alto Utility Company. For more information about smoke alarms, check out their web site.

,,,two little girls have just tragically died in a fire here - it makes me so sad that for the price of a smoke detector, their young lives likely would have been saved - Some may say we have enough laws on the books already - but these laws will save lives!  Common sense just isn't enough, sometimes.  Cheers, Wendy Betts - Vancouver BC

That is so sad, Wendy. It's a shame everything needs to be legislated, but when it's not people get lazy, take short-cuts, etc. Hopefully you'll get some laws on the books to cut down needless deaths. Keep getting the word out!

I just heard about this from Jeff Dowler, at least the carbon monoxide alarms.  Thanks for posting, Lottie.

Hi Jane -- this is a new law that makes sense.

I understand that carbon monoxide gas hangs low on the ground.  According to the new regulation, there should be one installed on each level of the dwelling.  Where should it be installed?
