Carla - This is great information for buyers who are looking to an Exclusive Buyers Agent in Portland.
I guess technically you may be (or are) right. I think most people reference what "they themselves" do and not the firm. Ie; Someone who practices family law in a firm that may cover may areas of law.
I personally am not exclusive to buyers or sellers but would be fine with someone that took no listings referring to themselves as a "Buyer's Agent".
Great information for Portland buyers! I also always find it interesting to learn how different each state really is. Here in Maine, most agencies use only appointed agency and as such the agents at the brokerages are not sub agents of the sellers of all of the agencies listings. There are a few areas of our state that do have some agencies practicing sub agency, but ours does not. Sub agency as it was formerly practiced in our state led to a lot of legal headaches and has all but been abandoned.
With subagency there, it's a wonder agents are claiming that. Well, I guess it isn't a wonder...some people will do anything.
Yep, that is exactly how I understand it to be here in California as well. Someone can call themselves a "buyers agent" but not an "exclusive buyers agent" if the broker takes listings. Good clarification!

Hi Carla...well said! I do both and feel doing both adds some credibility to my ability to represent a buyer or a seller. I know that is probably controversial...but just my thought.

Interesting to say the least. The term exclusive and its derivations is applied many ways in real estate, not always in a way the simplifies the term for the buyers and sellers of the area. There are exclusive agency listings and listings that are termed exclusive right to sell, and they mean different things. Now you've defined exclusive buyer's agent which is not at all necessarily compatible with an exclusive buyers agency agreement. I suspect we'll never reach a consensus of opinion on what these terms all mean, other than locally, and then only sometimes.

Hey Joe -- Absolutely, a Buyers' Agent. There are many agents working for a listing brokerage that perfers buyers. I GIVE UP A LOT to pratice Exclusive Buyer Agency . . . i.e., no listings. You'd think listing agents/brokerages would appreciate that and not take the ONE thing that I niche! HA HA HA

Hey Cindy -- nothing wrong with representing buyers or sellers. I prefer working with buyers, and for many years it was ALL sub-agency.
Hi Glenn . . . I use a contract when I represent clients. And yes, the "Exclusive Buyer Rep" agreement is SO CONFUSING! I wish it would be "Exclusive Buyer Representation" and not Exclusive Buyer Agency. The minute they show an office listing, they are no longer "exclusive" and might even be dual agent (depending on state law).
Hey Greg -- Yeah, not much back and forth referrals from Houston to Portland. You never know . . . maybe one day the Houston Astros will be the Portland Astros. We don't have a major baseball team . . . or football team for that matter. We have minor league baseball (the Beavers!!), oh, and the Blazers. Thanks for thinking of me, and HAPPY NEW YEAR!! Good post Carla. Consumers can't be reminded enough that exclusive buyer agents don't take listings and are 100% loyal to home buyers, 100% of the time.

I agree that agents need to be a bit more clear on what they do. Does being an exclusive buyers agent mean they would turn down a listing? How about a million dollar listing at 6%... i doubt it.

Hey Christa -- I, personally/professionally would absolutely not list -- no matter what the price. I market as an Exclusive Buyer Agent, and I market that my brokerage does not take listing. BUT . . . I would refer out in a heartbeat, and I do. Now, come on million dollar lisitng!! I would love to refer that out, and work with the sellers on the buyer end!! Thanks for your comment :-)

I am a Principal Broker working mostly on the West and far west side or Portland. I am almost he opposite of you, because I only worked and sold 1 buyer last year, and they are family members.
I am an REO listing agent.
I don't have the patience for buyers in this market. I am glad that brokers and agents like you are out there to help me get my listings sold!
FNMA just ended a promotion that gave 3.5% of purchase price towards buyers closings costs, and $1500 bonus for the selling agent. I watched about 5 buyers agents make an extra $1500 on my FNMA listings in Dec in additon to the .5% commission that they make more than the listing agent. It was great. A good buyer's agent work really hard for their client!
