What's the Difference Between Foreclosures and Short Sales?

Real Estate Q and AYou've got to love reading through some of the questions and answers on Trulia!  I always love to clear up the consumer's questions that seem to be so simple for us but, not so elementary for those who are not in the real estate business.  Here's the short version of a recent question that I thought needed a bit of clearing up: 

What is the difference in a foreclosure and a short sale and which is the best one to buy?


In response to the initial question - The difference between a foreclosure and a short sale is that a foreclosure is owned by the bank and a short sale is still owned by the homeowner of record. That homeowner is dependent upon the bank(s) approval of the sale of their property for less than what they owe on their mortgage(s). The short sale process can take awhile but, there are different schools of thought as to which is the best to purchase--short sales or foreclosures.

Consider this--Many homeowners who have lost their home to foreclosure, leave their homes angry and tend to stop maintaining or caring for their home, sometimes removing appliances and light fixtures as they are asked to leave their home, and sometimes even maliciously destroying their former homes as they leave the home. Many short sellers WANT to protect themselves from the 7-10 years of bad credit that a foreclosure can bring, therefore they do everything that they can to keep their homes maintained so that they CAN get a buyer and get out from under their mortgage with as little damage to their credit as possible.

Short sales can and often DO take longer than a standard home purchase or even a foreclosure but, the home that you buy, compared to other options (standard resale or foreclosure), can be in better condition and at a great price too.

Buying a foreclosure is easier on you and your agent but, if you have patience, a short sale can be the better investment, oftentimes requiring FAR less rehabilitation for you, as the buyer.

Very well stated.  Only a few years ago some agents couldn't answer this question themselves!  You touched on this in your post, but I will add that it sometimes takes buyers with exceptional fortitude and perseverance to see a short sale through to closing.

To the point correct post about the difference. One other note, short sales have only one buyer while REO properties are typically a competitive multibid process. Many prefer the one on one.

One other issue to look at is the likelihood of the transaction closing. With foreclosures it is much higher.

Debe - Could another explanation of the difference between a short sale and a foreclosure be this.  A foreclosure brings down the value of the neighborhood.  A short sale does not do as much damage to the values and preserves the comps for a neighborhood.

Great read Debe.  As a Home Inspector in Maryland I can totally agree with the fact that a short sale home is often left in Much better physical condition than that of a foreclosed home.

Hi John,  That's one reason I screen the agents and do my due diligence prior to submitting an Offer for my clients.  If the agent shares with me the bank, balance due, paperwork submission dates by the seller, etc. and I feel that the home is now WAY under priced (and I know the bank won't fight the offer) then, we'll move forward.  There are just so many agents who don't know how to list short sales and I find those transactions to be complete dead ends--those are the ones to stay FAR away from!

Debe, Thats the good thing about a short sale, that they tend to be in better shape than a foreclosed home. In a short sale it is the bank that decides on the price not the owner.

Debe, this is a good explanation of the differences. I recently met with a seller who was close to foreclosure. He had started removing things off the walls and selling them including the kitchen cabinets. His plan was to strip the home before the bank kicked him out. He even planned on selling the toilets,  bathroom vanities and sinks. It was a beautiful custom home but not much was going to be left when he finished. The risk of buying a foreclosure.

Great information and absolutely correct.  Unfortunately, many REALTORS do not know the difference between a short sale, defaulting on a mortgage payment and foreclosure.  I have personally found that most REALTORS that list short sales in and around Nashville Tennessee have no idea what they are doing - scary!  That is why it is important that financially distressed Nashville homeowners and property owners find a short sale expert to handle the sale of their short sale property.

There was a short sale on my street where some lucky buyer purchased a beautiful home with a Viking stove, Sub Zero fridge, master bedroom suite, etc. in great condition for 60% of what it sold for at the peak of the market.  Sometimes short sales are a better buy than foreclosures because of the condition.  This listing was on the market only a couple of weeks before going under contract.
