I was writing an offer the other day with Bob. As we were going through the purchase agreement we got to the paragraph that describes the property and the permanent improvements that are included in the property.
The contract states that all PERMANENT IMPROVEMENTS AND FIXTURES ATTACHED (unless leased or excluded) stay with the property. The contract goes on to name a long list of items that are considered permanent improvements and fixtures. The paragraph ends with AND THE FOLLOWING _______________________.
I wrote in REFRIGERATOR, RANGE, MICROWAVE, WASHER AND DRYER TO STAY WITH PROPERTY. Bob looked at me a little puzzled. He said "Why do we need to write those things in there? The MLS description says that all appliances stay."
ALWAYS HAVE IT IN WRITING AND INCLUDED IN THE PURCHASE AGREEMENT is what I told Bob. I'm pretty sure most sellers that advertise that the appliances stay would keep their word... but what if they didn't and we didn't have it in writing?
ALWAYS HAVE IT IN WRITING. Enough said.
