Blinded by False Hope!

 A couple of weeks ago I had looked at a house in Poinciana, that the owner had just gotten back, due to foreclosing on the previous owner. The previous owner was his son. It seems Dad, being the loving father that he is, bought this house for his son and daughter in-law, to help them out, since they had just gotten married and wanted a home of their own to live in. They only lived there a few months before they stopped making payments and after a year or so Dad had no recourse except to foreclose on them. He got the house back or at least what was left of it. This place was trashed.

The house was severely damaged from hurricane Charlie in 2004 and from what I can tell, the son received money from his insurance company but never did the repairs. It is my understanding they just continued to live in the house and then after a few months just moved out and took the insurance money with them. It had taken Dad almost 2 years to finally decide to go through the foreclosure process and reclaim the house. So when I finally saw it, it was quite the mess. Holes in the ceiling, black mold, gutted bathrooms and some kind of a partially completed addition on the back.

Anyway, my analysis was that the house, in good condition, would be worth from $179,000 to $189,000 but it needs about $40,000 to $50,000 worth of repairs. It basically needs to be gutted and rebuilt from the studs up. Dad wants to sell it "as is" since he is out of state and it just doesn't make sense to throw good money after bad. He had paid $159,000 for it about 4 years ago. I'm not 100% certain how he had paid for the house but believe he pulled the money from his home and paid cash for this property, then held a mortgage for his son, thereby giving the son title. Since the son only made a few payments, Dad told me he was out of pocket on the house to the tune of $220,000! Needless to say, Dad got screwed.

My suggestion, to him, was to list he house at $95,000, trying to sell in the mid to high 80s. Even though he would take a big hit, he really didn't have a choice. The house cannot be mortgaged, in the condition it is in and an investor, willing to pay cash, is going to want a good return on his investment. So I figured, an investor may buy it at $85,000, put $45,000 into it and sell at $189,000 for a net profit of $40,000 or so. Not to bad. If we got lucky. Of course Dad, would still take a major hit. But this is his reality. It is what it is.

Well I didn't get that listing. Another Realtor listed it at $150,000!! I couldn't believe it when I saw it hit the MLS system. $150,000!! The remarks section in the MLS state: Good opportunity for a 3 bedroom house below market value. Fixer upper. Needs a little TLC. Can you believe that? A house, that will need to be gutted is marketed, as needing a little TLC! I feel for Dad. He has been given false hope and is going to end up losing even more money. I am now curious to see how this turns out. I truly hope he is able to sell it for more than I had suggested. Maybe I was wrong. In this case, I hope I was. But I don't think I am. What say you?

I think Dad has been blinded by False Hope.

Hi Leigh, I do agree with you. I just have a hard time being negative on other Realtors or anyone for that matter. It's a fault of mine. TLW keeps telling me I live in my own little world. But hey I like my own little world, nice and peaceful:)

I think that the agent should be held liable for calling it 'TLC', when we all know that mold is a very serious issue and the walls need to be torn down (as you mentioned BB) to make sure there is none in the walls. TLC is such an understatement. Even if the agent is inexperienced, they should have advised to get a mold inspection to determine the extent of damage.
And the son doing such a thing to his father, after dad helped out by getting his son the home he wanted. There are no words for these actions.

Not being an active Realtor, I am no expert in pricing.  However, having had a real estate license, I do know that the current listing Realtor is not disclosing the condition of the property properly.

Ya win some and ya lose some. You're probably better off losing on this one.  Let us know what it sells for, if it ever sells.

I know the post was aimed at the son mostly for his lack of respect to the home and his father, but it is also the father's fault.

If the property was my investment, I would have come down immediately after the hurricanes to view the property.  If there was damage, I would have made sure that it was fixed.  Lenders have the same rights.  Shoved away in a standard Florida mortgage (bullet item #7) the lender has the right to inspect a property for damage - " 7. Preservation, Maintenance and Protection of the Property; Inspections. Borrower shall not destroy, damage or impair the Property, allow the Property to deteriorate or commit waste on the Property. Whether or not Borrower is residing in the Property, Borrower shall maintain the Property in order to prevent the Property from deteriorating or decreasing in value due to its condition. Unless it is determined pursuant to Section 5 that repair or restoration is not economically feasible, Borrower shall promptly repair the Property if damaged to avoid further deterioration or damage. If insurance or condemnation proceeds are paid in connection with damage to, or the taking of, the Property, Borrower shall be responsible for repairing or restoring the Property only if Lender has released proceeds for such purposes. Lender may disburse proceeds for the repairs and restoration in a single payment or in a series of progress payments as the work is completed. If the insurance or condemnation proceeds are not sufficient to repair or restore the Property, Borrower is not relieved of Borrower's obligation for the completion of such repair or restoration.

Lender or its agent may make reasonable entries upon and inspections of the Property. If it has reasonable cause, Lender may inspect the interior of the improvements on the Property. Lender shall give Borrower notice at the time of or prior to such an interior inspection specifying such reasonable cause."

He should have been more involved with his investment.  His son does not make a valid excuse.  If he loses money, it is his own fault for moving too slow and not excersing his options.  (Just my opinion)

That's sad - obviously, some not so reputable agent got to Dad and told him what he yearned to hear!  Let us know how this turns out - Dad got screwed not once, but twice! Good for you, being up front and honest!  Who knows? Dad may remember your honesty when the contract runs out with the bad guy, and come looking for you again.

Not to be picky, especially since I went off topic earlier, but were you referring to my comment about the mortgage, because I didn't see a Bill mention it and I want to make sure people can find it and see for themselves what I mentioned.

Again, just want to clarify and please keep us posted on the final outcome.  Sad state of affairs when you cannot even trust your own family.
