With the recent crackdown on illegal immigrants in Prince William County I started wondering whether it was legal to rent a home to illegal immigrants. After all what kind of accountability is there if they don't pay their rent?
Today I took some new clients out to look at rental properties and when I returned my broker had asked me if they were here legally and had proper documentation. I did not ask this question to this couple. They did not speak English and the daughter was interpreting for them. I explained to them all about the credit check, application, and processing fees and took a copy of their driver license. Just as I would with any rental client. I never asked the question about their status or knew whether it would be legal to do so or not. My broker and I discussed this situation in quite detail after my appointment with these clients and neither of us knew the answer. In our county the police have the right to check documentation status of all people that offend the law. But what is legal in the Real Estate community?
Prince William County is the first county in the US to take a stand against illegal immigrants and begin deporting these individuals that commit felonies. They are working with ICE to remove these offenders and deport them back to their country. Illegal immigration has become a huge problem for our county and its resources. After all these people are violating the law by coming here illegally. Over the next few months Prince William County is going to begin taking away county services to illegal immigrants such as social services, possibly education and health-care.
So what is our responsibility to our Owners? And what is legal when it comes to illegal immigrants and renting?
