Answers ~ Chattels and Fixtures Series

Ontario Real Estate Source

By Brian Madigan LL.B.

Here are a series of consensus answers. That is, most people have come to these conclusions once they have read some of the posts about chattels and fixtures. You will recall that a number of questions were posed at the outset.

There are still some grey areas and it's important to know that too.

Even with the most popular answers, there are still some who wish to argue the point.

Chattels

Annuals, chair lift, electric fireplace, roll-in fridge, daughter's homemade light switch plate, half can of paint, spotlight set in ground,

Fixtures

Above ground swimming pools, Buried swimming pools, a/c cover, cement slab under a/c, perennials, wall to wall broadloom (if nailed), cable wiring, closet organizer, garage cupola, wooden deck, flagstone patio stones, floating floor, built-in fridge, air filters, heat registers, interlocking driveway, keys, centre island (kitchen), pergola, precast concrete step, retaining wall, spotlights mounted to house and tree, built-in wall unit,

Grey Area

Wow Brian, the chair lift surprises me since it is usually attached to the wall. I assume the annuals are in pots not planted LOL. Wouldn't it be easier if the seller removed that special something before they want on the market? LOL.

Interesting that light switch plates are in the gray area. Considering that the protect one from accidental electrocution, I would think they are required. If one has designer switch plates, then they should be removed and replaced with common switch plates before listing the property for sale.
