Some Things Are Prohibited by Arizona's Residential Landlord and Tenant Act

Under Arizona law, some things are illegal to put into a lease. For example, a landlord cannot let someone live somewhere rent free in return for not maintaining the property. (A.R.S. § 33-1316). A landlord also cannot refuse to rent a place to someone because they have children. (A.R.S. § 33-1317) A landlord cannot contract away their responsibility to maintain the rental property (A.R.S. § 33-1315) Before a property may be lawfully rented, a landlord is also required to register the property with the county assessor and list the property owner’s name, address and telephone number. (A.R.S. § 33-1902).

A tenant may terminate a lease, after proper notice, if the landlord fails to maintain the property, fails to properly register the property, or fails to comply with other laws that material affect the landlord and tenant relationship.

I happened to post a blog today about California tenant's rights. Seems like such posts are more common here in the new world of real estate.

Mark ~ landlords really need to seek competent legal advice. There is much more involved than just renting a property.

With all the complicated laws in place, it would make sense to consult a qualified attorney like you to help them.
