ondran Law calls for Moratorium of Nationwide Foreclosure Sales - The whole foreclosure system is based on fraud and lies and must stop!

By
Real Estate Attorney with The Law Offices of Steven C. Vondran, P.C. Attorney at Law

Okay people, the wheels are coming off the foreclosure mill bus.

The Law Offices of Steven C. Vondran has seen enough and we are calling for a Nationwide Moratorium on foreclosure sales.  The entire system is based on nothing more than lies, false declarations, bogus MERS assignments of the deed of trust and promissory notes (as if MERS, a software company, ever held the promissory note), bogus subsititons of trustee in violation of the deed of trust, false declarations under penalty of perjury made by "robo-signers" and their staff who could care less about the law or any penalties that may derive therefrom. After all, they have money to make and borrowers are in default.

In short, the foreclosure process in America is a living lie (to quote Neil Garfield, the father of "produce the note" foreclosure strategy.  "You would not believe it unless you are in the pit reviewing foreclosure documents like I am" said Steve Vondran, Arizona and California Foreclosure Defense Attorney.  "This system is completely out of whack and not based on law, the lenders like everyone else, have to follow the rule of law" says Vondran.

"The lenders are nothing more than charletains looking to make a buck and they are willing to engage in carnival and circus like activities to foreclose on the next house."

Fraud, lies, corruption, false declarations, notaries in for the ride, robosigners who claim they are Vice Presidents of several different companies even though they receive no salary, show up at no meetings, do nothing for the day-to-day business and otherwise perpetrate a big lie on the county recorder and on the court.  Sometimes even the law firms seeking big time billable hours will go along for the ride and take their chances despite their ethical duties to the Court and to themselves.

In short, as my dad told me before he past away, "the answer to 99 out of a 100 questions is money."  People will do anything for money.  Very few of these banking charletains end up in jail.  They have made so much money they don't even care about jail.  They can hire twice the attorneys OJ Simpson hired to get away with murder.  Yes, money can buy you freedom.

So, where does this leave us?  The Ohio Attorney General is calling out GMAC and Ally Financial (the company trying to pretend it is different and the friendly neighborhood bank in its recent television commercials) and big damages and penalties await courtesy of the AG.  That may be great for the Ohio treasurer, but the real question is what does this mean for every homeowner who got the shaft through the lies, deception, fraud, and false signatures and recorded documents?  Do they get their house back until the lenders follow the law?

All this makes me ask, does the rule of law matter anymore or is there truly an elite class (including the Congressman, Bankers, and President) that is truly above the law and there is not a damn thing you or anybody can do about it?

Let's stop teaching our kids that this is a ation of laws if all we are doing is a paying a bunch of worthless lip service to the law and legal requirements.

For now, the Law Offices of Steven C. Vondran is calling for a nationwide moratorium and a criminal investigation.  I know nothing will come of it because money can't buy you love but it can buy you a legal defense.  That is what America is really all about.  Greed, Corruption, and Privilege.  I hope I can be like Michelle Obama and say for once I am proud of my country......but only if the rule of law can emerge and the scoundrels are thrown out of office, and foreclosed out of banking. Of course Democratic President Obama snubs his nose at the middle and lower class Americans and opposes a nationwide moratorium against the Bankers he bailed out.  And the banks are quick to say that although the law may not have been followed, everyone who was foreclosed on deserved it, in essence arguing the law is a mere technicality that need not be followed.  IN THE WORDS OF GOMER PYLE, "SURPRISE, SURPRISE, SURPRISE!"

PS - before I sign out, I want to tell you what a forensic document examiner recently told me.  Bank of America has temporarily halted foreclosure sales in all 50 states.  Sounds like great window dressing in light of the Ohio mess (and the mess likely occurring in every other state of the union).  However, they are now transferring the notes on the back-market to other entities that have no problem following through on the executioner's plan.  This I have on information and belief.  So be aware if you have a BofA loan.

Anyway, just thought you might like to know.
