As Professional Realtors we must recognize that we cannot interfere when a listing is already on the market. If we do, this violates the Code of Ethics. Realtors who are poorly trained, who lack the proper skills in general are now making calls and visitng short sale listed property owners and offering advise. Realtors, understand your job clearly. You are not an accountant or a tax adviser nor are you an attorney. If you resort to giving advise and interfere with the listing, and persuade the seller to change Realtors, you are in violation of the code of ethics. You can be called to task before a grievances committee and they determine what the penalty will be. Take note; Article 16-2 Code of Ethics Article 16-4 Realtors shall not solicit a listing which is currently listed exclusively with another broker. However, if the listing broker refuses when asked to disclose the expiration date and nature of such listing i.e. an exclusive right to sell or exclusive agency, the other Realtor may contact the owner to secure such information and may discuss the terms upon which the Realtor might take a future listing or alternatively, may take a listing to become effective upon expiration of exclusive listing. Play fair, there is so much out there don't risk it - Your reputation depends on it!
