Erin Toll, Director of the Colorado Division of Real Estate

Marriott Hotel, Lone Tree, Colorado

In a long anticipated visit, Erin Toll the new Director of the Colorado Division of Real Estate addressed a standing-room only group of WCR members and guests.

Erin who reminded us she is only on the job 10 weeks, is digging in and sorting out the mess she inherited.  According to Erin, when she set foot into her new office the Real Estate Commission had a back log of 260 complaints.  We Colorado Brokers know they stopped answering the telephones awhile back.  The problems have been compounding at the Real Estate Commission may soon see some action.  Erin got to "clean house" and hand pick and entire new staff.  She has borrowed terms from the TV show MASH and implemented triage to start off with the worst problems first.

Considering she was appointed to the position by the out going Republican Governor Bill Owens, and as of this month the incoming Governor is Bill Ritter a Democrat, there was some concern Erin Toll's job would be short lived.  But today Erin confirmed she loves Bill Ritter (an attorney, like herself) and she has no plans to leave her position, unless of course the Governor asks her to leave.

Based on what I heard from  her today, I think she is perfect for the job.  She was the one who has been bringing justice to the "re-insurance" scams, causing certain  Title Companies to pay back millions of dollars to consumers who were cheated. She did say the only ones who were punished were the Title Companies, not the Brokers and home builders.  This statement makes me wonder if there is something in store for them too?

Erin spoke of "getting the bad actors off the playing field".  A little mixing of metaphors, but totally understandable...we do have some bad actors here in Colorado.  RESPA violations and the kickbacks to unauthorized people i.e. real estate agents taking loan apps and getting a kickback for doing so will be a strong focus.

Affiliated business arrangements where the real estate agent and a company promise a certain amount of business to be delivered for a fee that is kicked back is illegal.

Mortgage fraud is a big issue occurring here in Colorado.  Erin didn't speak long on this issue, but as my hubby stated, that's probably because the strong arm of enforcement is getting ready to take a stab at some "bad actors."

Material misrepresentation was a big issue this year.  Something about an endangered preble mouse and a house. An agent knowingly sold a property to a New Jersey couple, where she knew nothing could be built because of the endangered preble mouse.  Another bad actor is off the street.

Gross Incompetency, there was not much illustrated here, but we full timers deal with this everyday.  Lack of supervision along with the proliferation of huge brokerages that merely hang licenses for a  cheap fee and don't' teach and train their agents.  We'll be seeing more and more of this, for sure.

Come this January we will be seeing some new laws come into effect.  Licensees will have to prove they are here in the U.S. legally.  Stronger laws for the disclosure and sale of homes that were meth labs will take effect.  Sellers who fail to disclose can be held liable for remediation plus the health costs of the buyer and legal fees too.

The Colorado Division of Real Estate is also responsible for administering to the Mortgage industry.  As of Jan 1, 07, all mortgage lenders must be registered with the state to do business here.  Part of that process includes getting fingerprinted and having a background check done by the Colorado Bureau of Investigation.  This process is lengthy and backed up.  Erin mentioned that if a person is in this industry and does not have an official license to work on Jan. 1, they will not legally be allowed to originate loans. At this rate it looks like many people will be standing on the side lines, or breaking the law!

Erin asked to hear from us in the industry what is happening and what is important.  Funny how up there in the ivory tower sometimes they are the last to know about the dirt on the street.  Guess with that said, we should take it upon ourselves to get involved, when we see a "bad actor" or a "rotten plot" we should be making the ivory tower aware of it.  Let's not let the consumer be harmed.  Let's police our industry.

Colorado Real Estate Trivia

Number of licensees = 37,413

Number of appraisers = 3500

Number of mortgage brokers = 2963

Something tells me that there are a few states, including CT, where Real Estate Commissions need a good housecleaning!    Sounds like you are lucky to have Erin

Wait, back up. Is Colorado going to register or regulate  Loan/ Mortgage companies? That's big!

I was recently told in a CREC update class that all of our fingerprints had been lost and we had to get them done again and send them before Dec 31. By broker called and the CREC did indeed have all of ours on file. But that was a close call. Being down here away from the crowd I don't always hear the facts correctly.

Great blog as usual!

Linda Davis ~ It sounds like things are in need of rehabing all over the country.

Dena ~ OK, so you've been under a rock?  :) Yes, mortgage folks will need to register, that includes getting finger printed.  After the first we will have no more illegal aliens originating loans, or so the law says...

Michele Bashor ~ I'll be happy to keep you posted.  :)

Chris Tesch ~ Yes, we are hoping for positive changes.

Rob Wills ~ OK, I believe we are worth watching!

Pueblo isn't exclusive for those kind of folks.  We breed them here too.  You would have enjoyed this session today.  Erin said she doesn't do much public speaking, because she's got so much work to do.  Gotta get those bad actors off the field...:)

Kristal,

Excellent update on the new regulatory push in Colorado.  It's a shame that we had to have such a large number of foreclosures before we received the attention of the Colorado Real Estate Commission, RESPA, CBI, FBI, etc. to go after the abusers.  It still amazes me the violations that occur--some intentional and some unintentional through lack of training (or lack of caring).  As real estate agents, some put the commission ahead of ethics and the law.  Let's all join together to clean up the industry.

What a mess...Erin has her work cut out for her.  Delegation and proper management are keys...and tons and tons of time!  Good luck.

I am having an ongoing dialoque with another local realtor about these "bad actors" and how they've been allowed to perform their acts far too often... without us shutting down their show!  If we knew we had strong support in the ivory tower it would be easier to justify the time and efffort involved.  Sounds like Erin has a BIG job and tackling it willingly and aggressively.   Would like to think that could happen in Washington, but big wheels turn slow and who has the time to grease them?

Steve ~ good suggestion about joining together to clean up the industry.

Chris ~ I agree, delegation and training are the key.  She appears to have the knowledge and management skills.

Carol ~ I think it would be a "dream job" to be able to come in and round up the "bad actors" get them off the street.  Like the sheriff in the old wild west!

Thanks for sharing the meeting - what a wonderful body of knowledge when we have summaries of learning experiences from all around the country.

Erin was lucky - so often government appointees come in to clean up a department, but are unable to change staff or bring in/choose a team.

I'm beginning to get an inkling of why the popularity rating of these professions is not as high as we would like to see it.

You know? Mr. Republican Governor was not as Realtor- friendly as I believe Mr. Democrat Governor will be, believe it or not. Even though CAR decided to back his opponent (at the worst possible time, I may add) - I think Gov.Ritter will forgive us, and I look forward to the chaos that is in our paths ... Triage! Great concept. We have a lot to work through, here in CO.

Colorado may have some of the BEST RE laws/contracts etc ...but, MAN! We sure need help in other areas. I CRINGE at some of the **** that goes on in our beautiful state. Glad that Erin Toll is taking the bull by the horns and calling a spade a spade!

...baby steps ... baby steps ...  Great Post, Kristal!

Are there any rankings out there, state by state, as far as which states have the 'cleanest' real estate industries and which are most illegal or unethical?

Eddy ~ The group was amazed by the number of LO's too.  I personally don't understand how they all feed their families!

Sharon Simms ~ Yes, I agree we are lucky to have someone who can clean house and build it her way.  Hopefully it will be the right way.  Somehow I have confidence she will do it right.

Angela Phillips ~ Sorry to hear Florida needs help...guess you aren't alone!

Tony Marriott ~ Guess I don't follow you...

Marianna Wagner ~ Mr. Republican Governor was so totally off regulation or appropriating money for anything at all, that's why we are in the fix we are in.  Yes, I know CAR didn't support him, but I think we needed the change.  The pendullum swings..it will come back!
Wow and you from El Paso County said that!!!  I won't tell Terry. Mum's the word!

Susan Trombley ~ all the numbers are insane.  Realtors to LO's.  We don't  need that many!  Want some?  I'll make you a special deal.  ;)

Kaushik Sirkar ~ How would you qualify "clean?"  Each state has different rules and regs. There's nothing "normal" about any.

Hi Kristal, I know this is an old post, but it came up as I was searching for what has been written about Triage on Active Rain.  It has been interesting to read your comments on Erin Toll.  I mention her in my post about Triage as well.  She is taking on a very big job and I hope she succeeds!
