Is "Lease to Own" A Scam?

We took the Aerial Tramway up the last time we were in Palm Springs.  While up there, we met a cute young couple who live in Southern California.  We joked, took pictures, and shared appetizers before we raced out to catch the next tram down.  Of course I gave them my card.  The girlfriend decided to give me a buzz today because she noticed that the back of my card indicated that I help people buy foreclosures and short sales in my area, Santa Maria CA and Orcutt CA.  She wanted to run a lease option scenario by me.  Unfortunately, she didn't have the name of the company on her.  But some company approached her about a rent to own arrangement where she would give them $160 and they would give her access to a database of homeowners who instead of getting a foreclosure would quit claim their house to you and you would just start making payments directly to their bank.  Hmmmmm.

Well I told her that it sounded like a scam.  Not a major league scam on the part of the people getting $160 for the "database" but there probably was a major league scam somewhere behind it.  I explained that quit claim deeds and foreclosures aren't typically a part of a lease option deal.  Also, my opinion was that a lease option doesn't solve the problem that is causing most of the foreclosures that I see - severe lack of equity and bad loans do -- so I didn't see lease to own as a real solution for many homeowners who were currently in distress.  And finally, I told her that any time anyone is quit claiming this or that over to anybody, and that new "owner" doesn't have a real interest in the property, it raises a red flag for me.  Doesn't mean it is fraud per se, but it does raise a red flag and I would have a reason to do a lot more investigation.

Of course, I asked her if her credit was poor because lease option offers are magnets for people with bad credit.  Indeed, she had a bankruptcy less than a year ago, but just found out that she is pregnant, so of course they wanted to get into a house.  I would hate to see a scammer take advantage of this wonderful couple's desire to establish roots for their new family.  They will, one day, be great first time buyers and I want to protect that future for them.  There are legitimate lease option offers out there, but I do not think that this is one of them.  A basic lease option deal is a lot less exciting than the scenario these folks described.  She did the smart thing though - she ran it by a Realtor® and attorney that she trusted and it kept her from getting burned.

Glenn - You are absolutely right.  That's the biggest issue with lease to own anyway.  Most people don't understand that if the property has a mortgage they probably don't have the ability to do a lease option easily.  That is why an attorney should be involved both on the seller side and the buyer side.  If you are cash poor and don't think you can afford to have an attorney look over your lease option deal -- well you probably shouldn't be doing it at all.  There are too many pitfalls.

Hi Jerry - Yes, it was smart for her to make a phone call.  It can be difficult to think rationally when someone is offering something you want but you can't have.  They really prey on people's emotions.

Bryan- Very true.  That's my rule too.  If it sounds too good to be true it probably is.  Maybe I've missed out on the opportunity of a lifetime here or there -- but I doubt it. Katerina's post today reinforced that I was probably right.  I think this is just the latest and greatest from the "quick money crowd."  Why can't these people just get jobs?  Really, working for a living is not that bad once you get used to it.  LOL.

Yes unfortunetly we're seeeing this type of scam pop up in our area as well.  Preying on the vunerable once again. Glad these two were smart enough to get our advice before buying the line hook, line and sinker.  We do need to get the word out....

Vegas Bob- Very true, people don't need to pay for a list.  I won't presume to speak for the entire nation (I'm not a member of the media - LOL) but I will say in my area of CA, I have seen very few legitimate lease to own opportunities in the residential market right now.  And, yes they are complex!  So many pitfalls.  Thanks for the feature!  Glad you liked the post - I agree it is an important issue.

Peggy - Yes, I'm glad she called.  I hope she heard me and doesn't get talked back into it.  They get to people on an emotional level so they stop thinking rationally.

Christine - I agree it sounds fishy.

Chris Ann- I don't think I would ever do a lease option - I'd rather just save my money.  My father did one once, but that was because we needed to rent a house and he hates renting -- he wanted to feel like he was getting something for his money.  LOL.  After living in the house and learning all the maintenance it needed -- he declined the purchase.

Gene - That's what I'm thinking.  Why would you take on a bad loan that was driving someone else into foreclosure?  If they weren't underwater why wouldn't they just cash in their chips and sell the home?  I'm the kind of person that you have to make it make sense to me -- there has to be something in it for you and something in it for me.  It all has to come together.  This one did not add up for me.

Joe Kenny - Very true.  I think that they get all of this loot and then have to pay it all to a lawyer trying to stay out of jail.  I wonder if they've done the math.  Oh well.

Thanks for the feature Anna!  Yes, I agree and do think it is important for Realtors to get the word out as well.  If it sounds too good to be true - it probably is.  This is especially important because behind it is a person who wants to buy a home -- and that directly affects our industry.

I am also seeing increased interest in Lease/Options, and all too often from people who should be running away from them.

Even when there is no scam, the closing rate is so low, hopes are dashed too often.

Tni - Having to buy a list of rent to own opportunities would be a red flag to me. At least this young woman was smart enough to give you a call and get your professional opinion. Saved her $160 at a minimum.

Conrad - Very true.  You have to be looking for the catch.

Mike - I do believe that most people with poor credit would do better to just wait.  In three years when you have other options that lease option may not look so good anymore anyway.

Judy- Yes, I agree at least she saved the $160.

Tni, this indeed sounds scammy to me.  And it's too bad.  I bought my own house with a lease/option many years ago, and it worked very well for both me and the sellers.  I needed time for a bunch of stuff that was under contract to settle, and the seller needed time to meet a capital gains deadline.  People like the ones you are writing about give this a bad name.

$160 for a database? Wow. Some people are so resourceful in finding ways to make money

Sometmes I really think many of them could do well doing something legitimate, as they do crazy things to get little money on scams, that they should have doing at least not worse doing something legit
