Most lenders will not lend on condos where there is active or pending litigation. I had a lender that turned down a deal on a condo simply because there was an unlawful termination lawsuit filed by a former employee of the HOA.
We just sold a house where there is a ruled on lawsuit with the HOA and a water company. Of course the ruling has been appealed so it is no telling when it will be over. But what a pain.
Thom, this is so true! We have a couple that I know about in downtown Denver, and it ABSOLUTELY affects a potential sale. Very worthwhile checking out your condo associations!
