Land Locked-To be or Not to Be

By
Real Estate Agent with Real Estate America

I own 9 acres of river front property.

There is a well traveled route to my property. 6 miles east of Sandridge Road and Highway 49. Plymouth Ca. and North.

Middle fork Consumnes River.

It is not paved.

I have to go through others property on this road to get to mine.

After I bought it, I took my Gold Dredge and tent and was camping.

An old Man came and said its his property.

Yours starts down there somewhere.

Anyway, he brought the Sheiff down to escort me off.

He does not want me to go through his property to get to mine.

The people in the area use my property to use the river too.

Any Lawyer out there that would fight for a USMC Veteran after gettig arrested for tresspassing?

Can he Legally keep me from access to my property?

If not what law and # can I find info on Land Lock type situations?

Thanks Michael

I'm in CT and since laws vary you should first check in the deed for a right-of-way and/or travel easement.  It is not uncommon in my area to have no legal access to a land-locked parcel.  Sometimes if you talk with your abutters you may be able to work something out and get an easement from them.

Michael, Jennifer gave good advice.  Get an attorney.  He/she will most likely go after the party that sold you the parcel.

Mike, when you bought the property, did the seller disclose if they had an easement or an easement by prescription?
