Private Property Is More Than Just The Land Under Your House

Private property is more than just the land that you own under your house or the land you own on your ranch or farm. 

• Private property is also the house that you built on the land that you own. 
• Private property is also the intellectual ideas you have in your head, the writing that you write in a book, the content you thought up with your mind and published on your blog.
•  Private property is also the inventions you thought up, the products you invent and thiings like software, websites and design work. 
• All of this is your own private property. There are a lot more but for this post we are staying with these property descriptions.
• And you have the rights to your property and that is why we have the best patent laws and copyright laws in the world. 

You are not going to hear this on the news and you are not going to be reading this in the big papers. 
 

Remember always that whenever there is a huge story being stirred up in the press and media, the one that all those politicians argue over and get us all worried about so that our ears and eyes don't look at anything else. The bigness of these political battles shield the politicians from us seeing what other bills and laws are being passed without us knowing about it. All administrations do this. This post is not a partisan post. 

This is a post that ALL bloggers, middle class Americans, inventors, scientists, poor people, writers, small business owners and anyone who is an entrepreneur needs to pay attention to and call your elected officials first thing Monday morning or the next day they are open for business. Tell them that you know about H.R.1249 America Invests Act and that it is a job destroyer, it is unconstitutional and will hurt innovation. 

Tell them to vote NO on H.R. 1249. 

Both parties, both sides of the isle are ramming this bill through without a public debate or discourse. This is the bailout for their multinational corporate buddies giving them trillions of dollars of new wealth while hurting the tax payers, you and me and all our small businesses. Not only that, this bill is totally unconstitutional.

H.R. 1249 changes our patent system that is already established in our constitution in Article 1- Section 8- Clause 8. Tell them you want them to keep our FIRST TO INVENT patent system. 

"To promote the Progress of Science and useful Arts, by securing for limited Times to Authors and Inventors the exclusive Right to their respective Writings and Discoveries."

The White House along with many of the 'tenured' Republicans are working with some of the biggest multinational corporations to change our patent system to become like Europe and Japan.  The U.S Patent Chief David Kappos is an elitist and cares nothing for the little guy that is trying to make in in America. He was just in London telling other elitists that our Constitution Patent clause is SO 19th century and "bizarre" and that we need to be more into "global harmonization". Those words to some may sound warm and fuzzy but the reality is very much the opposite. 

Our founding fathers specifically addressed the Patent process because they wanted to get rid of the way that London and Europe handled the Patent process. You see, in Europe, the little guy did not get the patent. It was not first to invent but rather first to pay. So if some big friend of the King had more money than you, guess what! You got stuck out in the cold while they cozied up together. 

If Americans can not control the fruits of our own labor and that of our intellectual properties and technology inventions, our writings and our programs, our systems and anything else we invent than we will be in big trouble with job creation and the ability to create our own wealth from our inventions. Intellectual property and copyrights are the new currency in our economy. And that is precisely why the big corporations like GE want to control them all. 

The founding fathers, when they wrote Article 1 Section 8 created a level playing field for the poor and the rich. The poor man could invent a car in his barn and become wealthy from his invention just as easily as a rich man could pay to invent a rocket ship in his factory. By awarding Patents to the actual inventor more people could dream and design new inventions. 

So now those who owe favors to big multinational corporations want to go back to the European system to the first who files the claim. Now that is going backwards in spite of the rhetoric they spew at us. In this one bill, multinational companies can sweep in, grab the patents, take them overseas where more jobs will be taken away from us here. The manufacturing states will be hurt the most. 

There have been scholars who have examined this bill and say it violates our constitution. Not one scholar has come forward to say that this bill is NOT violating Article 1. 

The Senate has already passed a bill like this and in the House, H.R. 1249 is moving very fast. Many members of both parties are planning on voting for this bill.
