I showed 9 houses today, with drive-bys on a couple of others.  Client is fairly serious about one of them, and considering a couple of others.

And we have no disclosures from the Sellers.  Now, a foreclosure does not require a North Carolina Residential Property Disclosure Statement.  But, other resales do.
And out of 14 listings I pulled, only two had the forms uploaded to the Triangle MLS.  And none of the ones we viewed had any documents in the home for visitors to carry away.
Ergo, it is necessary to connect with the listing agent and request documents.  If one can make contact.  So, there is often a delay in receiving mandatory documents.

Bother.

Triangle MLS lets us upload all the documents a Buyer needs to make an offer.  We have space for the NC Property Disclosure, Owners' Association Disclosure, and other required addenda, if the files are not too large.

I work to make it easy for a Buyer to write an offer on a listing.  The disclosures are on the MLS Listing, and in the house.  
Why not?
No bother!

I am seeing more and more cases of homeowners refusing to provide disclosures and I see the writing on the wall... lawsuit city ahead.

In NC, we just would not be able to take that listing.  It is required of the homeowner, by law.

They can legally indicate, "No Representation," but they must do that.

Mike,  Good for you...looking out for your your buyer's best interests and making sure you get this important information.  Too many times, seller's agents take short cuts like not posting any pictures on their MLS listings, and providing minimal information on the mls.

Mike, We make it easy too.  Disclosures as part of the brochures in the house, uploaded to our MLS listing, linked to feed back from our showing service- CSS, reception desk at our broker's office has a scanned copy, and I keep a scanned copy in my email that I can send to anyone at anytime :)  I don't understand why some agents make it so hard to sell their client's houses!  I've heard some claim they don't distribute disclosures because they use requests for them to gauge interest in the house.  I say nothing shows interest like a contract!

It may be a little selfish, but with the law requiring disclosure forms, I am also looking out for MY interests.
The funny thing is, the agent can upload to MLS once, or be chased routinely by Buyers Agents who want a copy.  Alternative 1 seems to make more sense, at least to me!

Some parts of real estate aren't that hard.  Why do agents do everything to market a home and then make it harder.  I especially love the agents who tell me that they are CDPE "experts" and haven't got a clue.

Mike, Why don't they. Laziness. Here the disclosure has to be provided before closing or the buyer can walk. But agents and sellers are just asking for trouble if they are not provided.
