Designated agency and facilitation in New Hampshire?? It could very well be.

Wouldn't it be nice to say Good Bye to Dual Agency?

On Wednesday, October 17th there will be a special Board of Directors meeting held at The New Hampshire Association of REALTORS in Concord.

The sole purpose of this meeting will be to have a motion to approve the proactive legislation “Relative to Changes to the Real Estate Practice Act”. This is the legislation that, if approved, would enable the practice of designated agency and facilitation in New Hampshire.

It is the recommendation of the Agency Task Force that this be approved.

We tried to get that here in Hawaii a couple of years ago and it died in the legislature.  I hope it makes it through in the next session.

I hope we make it through the legislature.  Last time we tried we're stopped by the Exclusive Buyer Brokers...I'm not sure if they'll support it this time. Sure hope so!

Monika, we passed it here in Michigan several years ago. It stopped tons of dual agency agreements because now 2 people in the same brokerage can still maintain their fiduciary relationship to their buyer client or seller client. I wouldn't work any other way.

Every office (and if it was a multi-office like we are) had to pass it to participate. Now it is right on our Disclosure of Agency Relationships form that we go over first with anyone we meet with.

Ann Arbor had it for years and when we became part of a multi-office ownership, they had to vote and pass it too. Some agents were reluctant because it made them have to learn a new term. ( go figure )

However, it is the BEST representation you can continue to give your clients, if they find a home already listed in your brokerage. The only way we are dual agents anymore is if I sell my listing to a buyer client.

Hi Monika - we really SHOULD have it pass this time around.  This time, more people are better educated about it and it really is the BEST way to go.  I'm also a licensed Broker in Maine, and we've been doing it that way in Maine for several years.  It really cleans things up so much better than the archaic way we're presently doing things in New Hampshire.

It's high time that we get things done that are for the better of consumers and not be hampered by groups protecting their turf.  Sorry if that offends any - just how I feel about this piece of legislation.

Ann...I think we'll be in for a battle but I sure hope I'm wrong. I agree with your feelings...we are an association of REALTORS not just an association of sellers agents or buyers agents. This will be best for ALL of us and for the consumer. I just hope we stand together!

Monika, a few months ago this Dual Agency was a hot topic here on ActiveRain.  Most Realtors seem to feel that Dual Agency created a conflict of interest, but there were still a good number that defended it, so I think that you are right in expecting a battle.  Dual Agency does seem like a conflict to me, not only on a business level but also on an inner personal conflict within yourself.

Hi Monika-we are a transactions brokers...In the state of Florida we can work for both parties with limited representation.  In 2008 it will be standard to work as transactions brokers.  I always had difficulty in handling both side of a transaction.  never did I enjoy it!  Good luck...
