The  MERS mess. What does it mean when you are representing a client?

 

  This is an issue that’s going to stretch across every market. As recently as this morning I had a transaction pulled because of this issue. I’m involved with another situation with a delightful client and in speaking to the Listing Agent this morning and when I asked that question he tried to duck but he had to check for me. Listing Agents should disclose that information BEFORE an offer is presented to them. I’ve been in contact with the title company I use to help me through this mess.

 I can see clients suing their Buyers Agent because they spent their hard earned money and in the end they will not be able to close the deal. Just when you thought it would be easier out here another issue arises. I spoke with a fellow agent in a different county and he told me they pulled 3 pending transactions of his. Those commissions could have been accounted for his business or personal life but for now they are gone. Remember in the course of your day setting up showings this question MUST be on your list. It could save you lots of headaches and lost commissions.

My MLS board is having a MERS class soon, and I will be attending. I don't understand it, and I have only been in short sale transactions where Attorney were handling it. I hope that is covering me for now.
