Disclaimers are extremely important to have on all your listing marketing material both on and off-line; especially now that the market prices and interest rates are fluctuating. Typically, the disclaimer is placed at the bottom of your listing flyer or listing brochure. In most cases, the text size can be very small (approx 6-8pt font) and it can be watermarked. The key point is to have some type of disclaimer on your marketing materials. Below is an example of the disclaimer we automatically place at the bottom of our flyer templates.
It reads:
"The information contained herein has been obtained through sources deemed reliable but cannot be guaranteed as to its accuracy. Any information of special interest should be obtained through independent verification."
Here are a few examples you can use or add to your marketing materials (feel free to copy and paste)
The information contained herein has been obtained through sources deemed reliable but cannot be guaranteed as to its accuracy. Any information of special interest should be obtained through independent verification.
The information contained herein has been obtained through sources deemed reliable by [INSERT YOUR NAME] or [INSERT BROKER NAME], but cannot be guaranteed for its accuracy. We recommend to the buyer that any information, which is of special interest, should be obtained through independent verification. ALL MEASUREMENTS ARE APPROXIMATE.
[insert your name or brokerage name] has made every effort to obtained the information regarding these listings from sources deemed reliable. However, we cannot warrant the complete accuracy thereof subject to errors, omissions, change of price, rental or other conditions, prior sale, lease or financing, or withdrawal without notice.
The above disclaimers are general and should serve you well; however, if you'd like to get really thorough I'd recommend seeking the advice of a real estate attorney.
I hope this helps. If you have a disclaimer you'd like to share, please feel free to post in the comments.
