I'm not sure about most of you folks, but the closing attorneys in this county need a real gut check.  I understand it is my responsibility to make sure everything is moving smoothly and I do without complaint.  I have a problem when you have to do everything.  I mean what are they paid to do punch numbers into a HUD automated program.  I do have one closing attorney that does get it, but for the most part the others are in a sad state.  I haven't seen a HUD statement before a closing in almost four months.  And many have had to be changed at the closing table.  Do any of you have these same problems.

I think it has less to do with attorneys and more to do with "averages".  In every profession, you'll have great performers and absolute slugs.  Thank goodness the worst of them are not that plentiful (the free market at work I guess).  But the thing is, most of them are average.  The same can be said for realtors, accountants, cops, etc.  There are great ones.  There are poor ones.  And there are a whole lot of average ones.  Find the ones that work best for you and use 'em, refer 'em, compliment 'em and avoid those who just don't get it.

Brandon, Maybe this is a stupid question, however are they not required to get the buyer the HUD at least 48 hrs before closing?

Definitely and it is horrible when it happens in front of your clients because since you are the agent, you are the one who looks bad!  I would suggest finding one or two companies who do GET IT and stick with them!  It's the same thing with loan officers!  You only need to find one that does it right and stick with them (maybe 2 but just for the backup role like a backup quarterback in case your primary is out of town or on vacation!)

In Ct, our real estate attorneys do earn their pay.  Our HUD statements are seen before closing. They are good to go to for advice, and for reassuring the clients, as well.

Brandon - I have had the problem several times, but I have found one that really gets it, and I try to recommend them whenever I have the oppotunity.

Everybody sues somebody sometime in NJ, to avoid that we Realtors recommend attorneys. In reality a title company could handle everything. Realtors have gotten so use to having attorneys do everything for them including negotiation it is sickening. And even that usually the para-legal with no negotiation skills tries to handle it, most times when you have two Realtors who know the old ways, they can get to the closing table quick and in a hurry, and hope the attorney has even prepared the HUD statement which is usually done that day.

I've never had an attorney handle my negotiations.  And it's been my experience that the lender causes most of the delay with the HUD being provided in a timely manner, not any attorney's I use for closing.
