Texas Real Estate Licensing Requirements are Changing

Texas Real Estate Licensing is having some rule changes. A couple of changes seem to be for the better, but a couple seem to not be...

The first one that I would totally and completely agree with is that you must be a Salesperson with FOUR years ACTIVE experience in order to apply and receive a Broker's license.  This is changed from two years and I believe the word "active" is new.  I like this because too many people straight out of real estate school and barely any experience were immediately trying for their broker's license without any "real world" knowledge of how real estate worked. However, this rule doesn't apply until January 1, 2012. I can picture it in my head that all these newbies will be running down to TREC in order to get their Broker's license now rather than waiting a couple of more years...

Something else that I like is that the newbie continuing education requirement.  In the past (and the present, since this new requirement doesn't start until September 1, 2012) a newly licensed agent had to take 30 classroom hours each year for the first three years. The change is that they must now take those 90 hours within the first two years.

You would think something like the education requirement would make sure the agents are smarter and more competent, but then they made a couple of changes that I don't agree with.  As of September 1, 2011, a person can take a year to pass the licensing exam instead of just 6 months. Who needs a year to pass this test? If you don't understand the material and need to take the test multiple times, this isn't a career for you!!

And something else I disagree with is that they're waiting until September 1, 2012, more than a year from now, to require a six hour "broker responsibility" course for anyone who sponsors or supervises another licensee... why can't they implement this now?  Way too many brokers out there who don't know how to actually advise their licensees!!

At one time I thought about getting my license in Texas since I'm only 20 miles away from Texas...but I stay so business in my area that I decided not to go through the hassle to take it on.

I too agree Donna, why wait until 2012?  You would think that waiting until then will actually defeat the purpose.  What with so many agents running around claiming to brokers and don't know the first thing about being a broker in this challenging market of today.  What are they going to do, wing it?

I disagree with the four year salesperson requirement.  There are many agents who after two years of activity are ready to get their brokers license.  There are agents with 20 plus years who are not ready.  In additon to having your license for 4 years TREC will have to write rules about what else is required to get a brokers license.  TRELA has mandated TREC come up with a rule.  Who know what their requirement will be but more then likely it will be tied to productivity or acting as a team leader/ office manager.

Also currently the SAE requirements call for a new licensee to take two 30 hours courses within their first year.  What TREC is not doing is reducing the hours to get your license and then adding that amount back into your SAE requirements.

Good for Texas. But I'll bet it's still too easy to get a license, judging from all the poorly qualified people I run into out there...
