We Are Our Clients Agents. From Nurse to Real Estate Agent the work is Very Important.
This is a great blog from Kathleen...I agree with her wholeheartedly! I will be disabling comments as this is a reblog and if you agree as well go over to her original post and let her know...tell her I sent you!
Before I was in real estate, I worked as a Registered Nurse in Inova Fairfax Hospital, Alexandria Hospital and Mount Vernon Hospital. I was a trusted professional and took my work seriously due to the scope of the work and what it entailed.
My family was in construction, my father was a builder and bought and sold many homes through his life and what ended up to be through my life also. It was a natural move for me. Many times people have stated to me "what a change of profession." Well....yes and no. I took care of many patients that certainly were in different stages of their life. It was very important work. It is just as critical to live happy and fully when we are well, and living our lives every day.
The responsibilities we have as agents working for our clients is very important. A lot of the confusion from the public, in my opinion, is not fullly understanding the role of their agent and the agency relationship. Good agents take this responsibility very seriously. We are agents for our clients whom are selling their homes so they can move forward with living.... or for clients finding the right home and the right lifestyle. As the agent and professional for our clients we write offers, negotiate offers and contracts, go through the contract phase with inspections, negotiations again, financing, and settlement. All within the legal scope of the law, we are our client's agents.
Agency is where the lack of understanding lies.
Common law in Virginia gives us the definition of the agency relationship:
It is a fiduciary relationship that results when one person represents the interests of another person in dealings with other parties.
A fiduciary relationship? According to Merriam-Webster the fiduciary relationship refers to that: held or founded in trust or confidence.
Most Real Estate Agents act as limited or special agents when working with the general public. For example, to find a ready, willing and able buyer/seller under the terms and conditions acceptable to the seller/buyer.
Agency Duties to Clients are:
- Due Care and Diligence
- Loyalty
- Obedience
- Confidentiality
- Accounting
- Notice and Disclosure
This is quite a responsibility to take on in an Agency and fiduciary relationship. That is what every agent has the responsibility to perform with each and every client when the special agency agreement is in place. Unless a different legal relationship is intended and is agreed to.
So once again....yes and no. There are actually many similar components in the fields of both my chosen professions. I am still a trusted professional and take my work very seriously due to the scope of the work and what it entails. This is such an important part of my clients lives. Living life to the fullest and living life well whether it is moving on or moving in.
It is also usually one of the biggest financial decisions in their lives.
