Re: Pre-1978 Construction Homes (Buildings)
So much paperwork in selling and renting homes. Different states have different amount of paperwork and notices that must be given to mostly buyers and renters (certain renovations are included also). What ever happened to the Paperwork Reduction Act? Well some PAPERWORK is a GOOD thing to protect ALL consumers!
In addition to the Seller's Disclosures/Tenant Move-in disclosures (check-in inventory forms of one sort or another) that most states require Sellers/Landlords/agents to furnish to the buyers/renters, one important form that must also be given is information on lead (Pb) based paint hazards involving homes constructed prior to 1978.
This is a Federal requirement that applies in all states. Different states may have different forms for buyers/sellers/renters to sign off on passing on this info. Nevertheless, there is one document that is universally required for sharing: EPA Pamphlet - "Protect Your Family From Lead In Your Home" - EPA 747-K-99-001, September 2001.

Lead based paint and any lead compound ingested/inhaled can detrimentally affect key target organs resulting in organ failures, damage to the nervous system including proper brain development in young children and subsequent loss of motor-neural function, and eventual shortening of life expectancy.
Looking around in many communities throughout the country, pre-1978 construction is everywhere. So, Sellers/Buyers/Renters/Realtors/Appraisers/Home Inspectors/Contractors need to remember and communicate the potential for lead based paint hazards in those homes. The burden of informing and sharing the info rests with the property owner. However, Realtors have obligation to property advise their clients about the requirement and the distribution of the EPA Pamphlet.
Realtors may want to have a link to the EPA or HUD websites for this info and/or provide a PDF document on their websites.
