Docs Sent 6 Times But Never Arrived and You Tell Me Not to Worry?

I’m in an escrow representing the seller of a great San Jose Lynbrook High home and the buyer’s loan agent is someone I know and trust who has always performed well and quickly before.

Appraisal and contingencies were removed 2 weeks ago, but we are still waiting on loan documents! I’ve been told about “technical difficulties”, “someone attempting to hack into B of A globally”, and “having to manually do things.”

But when I heard today the loan processor said “The Docs Were Sent 6 Times to the Title Company…But They Never Arrived!” I’m sorry there is something extremely wrong with this picture. Especially when the loan officer keeps telling me not to worry.

I asked why not Fax the documents? “We don’t do that, too many pages.”

So I said why not eFax them? (send it from your email to their fax machine). “No it’s not set up for that.”

So I asked if they could try sending it to another email address within the title company or me! Just see if their system is actually able to send out to anyone! “I’m sure it will get there.”

Keep in mind the big reason we took their offer was because they absolutely could close by June 30 – and my clients are moving to India July 2. I want to know they got their money before they leave the country – and actually, so do they. There is no excusable reason for the delay.

We’ve been told these docs were coming “any day” since last Thursday when I signed the seller off. It’s been a week now. It’s an easy loan.

Today the buyer agent slipped up and said he’d heard it was due to “new staff not familiar with the system.” THAT makes sense. Perhaps they don't know how to email.

I’ve been told they can table fund-but that can only happen after the docs actually get to the title company, the buyers sign them and buyers bring in their money! I just want to get all the way ...

Tonight I emailed the title company & loan rep and offered to pay for a courier AND asked them to re-send those docs to the title company’s branch manager.

Any other suggestions are WELCOME!

Michelle, I am sorry, but that's a CROCK of CRAP! not be able to eFax? a doc is saved on a computer and you attach to an email! how complicated is that???? that's how you send off a computer! what do you mean it is not capable? it's a computer! that's UNREAL! I hear a bunch of excuses!! WOW! I feel for you having to deal with them! How about they should be OFF your list of title companies!!!! That's a huge start!!!

Lauren it's not the title company, it's Bank of America - they are the ones experiencing the "technical difficulties" - I think they don't know how to use email!
