Short Sale Agents Now Exempt From Federal Trade Commission "MARS" Requirements

In a rare nod to common sense, the Fed Government has recognized and corrected a glaring error it had made in requiring Short Sale Real Estate Brokers to comply with rules intended to address fraudulent Loan Modification activities.

As of 7/15/2011 real estate brokers/agents engaging in Short Sales are no longer subject to the FTC "MARS" rules, which are still in effect for those engaging in loan modifications. You can read the entire text of the announcement HERE.

It is still the law on the books and as of July 21, enforcement is not the FTC’s call anymore.  MARS enforcement will be handled by the new Consumer Financial Protection Bureau (CFPB).  This means the CFPB will decide how to enforce the rule. We got only a one week moratorium from MARS. So, don't throw away those disclosures yet. Not until the CFPB decides whether to change the law.
