The following is great news for all families looking into or in the process of a short sale.

Please read it completely as this is a great short sale victory for all California home owners.

Gov. Jerry Brown signed his second real estate related bill last week, SB 458.

The Governor Of California signs a landmark law allowing citizens of this great state to walk away from deficiency judgements through an approved short sale.

Through the process of facilitating short sales in California during this market correction I have had to and gladly did negotiate language into short sale approval letters to prevent my clients from being sued latter by a junior lien holder.

Governor Brown has now made it easier for the homeowner to procede with a short sale. In recent times and years past many sellers would have to file for bankruptcy to remove a deficiency judgement by a 1st or junior lien holder. Sellers who wish to short sale today can get approvals and not worry about a deficiency judgement, thereby salvage their credit and work to improve their financial situation without concerns about law suits regarding a deficiency. This is a huge step in the right directions to help the people of The State Of California.

SB 458 also has an urgency clause that makes it effective upon signing.

Our previous law (SB 931 of 2010), a first mortgage holder could accept an agreed-upon short sale payment as full payment for the outstanding balance of the loan, but unfortunately, the rule did not apply to junior lien holders. SB 458 extends the protections of SB 931 to junior liens.

If you ever considered a short sale you are now free to move forward with your plans and get your short sale approval without concerns about being sued latter by a mortgage lien holder.

A big yes for the people of California. Thank you Governor Brown for demonstrating good leadership in troubled times.
